Section 59 of the Police Reform Act - Anti Social Driving Offences covers the following:

• Driving in a careless or inconsiderate manner
• Driving on common land, a footpath or bridle way or any land which is not part of a road
• Driving in a manner which is causing/has been causing, or is likely to cause alarm, distress or annoyance to members of the public.

If doing any of the above then a Section 59 warning can be issued to you. This warning is placed against both the driver and the vehicle and lasts for 12 months.

If the driver of the vehicle or the vehicle with the warning issued to it is then seen driving in any of those conditions again in the next 12 months the vehicle can be seized and, if not collected after paying for recovery and storage costs, it will be crushed. Please note that this relates to either the driver with the Section 59 or the vehicle

Signs warning of this have been erected at both ends of every footpath / bridleway in Calderdale about 18 months ago.

I live on a bridleway so drive past one every day .....

Interesting point - "Michael Gargett Problem is that a section 59 is often issued according to the police officers opinion, which is no basis in law. His word against yours."
So if the Rozzer's having a bad day, you're screwed anyway.

At least most of the offences on a lane won't be speed related

mostly.... I'd wager there's next to no chance of overtaking horses either.

Judging by our behaviour when laning we have nowt to fear..... unless a rampant bobbly is a judge or chief constable....

Hmm.. does this mean if we meet an arsey mountain biker,, we can get his bike impounded?

I have recovered both road legal and non legal 4x4s from thetford forest some on lanes and some on illegal routes for the police when they have been seized.
A few months ago we sent a Suzuki sj toy to the crusher. It was lifted had mud tyres Eco cage etc on it but wasn't road legal and wasn't on a legal track.

So these things do happen.
