55K miles on a 05 plate with all them things wrong on a Volvo - i'd say you need to HPI it - it has either been in a massive smack or seriously clocked. That would imply a relatively easy live at around 8K miles a year, but the list of defects would imply different!!! Is there any service history? Any receipts? Anything?

Full Service history - Not all Volvo but all there.

There are a few scattered receipts for things, Nothing out of the ordinary, Locking wheel nuts, Air filter, Oil, few other bits.

It's completely HPI clear. Only thing that was flagged on it was that it had a private plate change earlier this year.

I think it has been in an accident but not recorded damage and repaired.

I bought it based on 8k miles per year isn't that bad, And that 55k isn't high milage. The engine is the same as used in the Ford C-Max and Focus. I have had both a C-Max from 40k to 120k and a Focus Estate 35k to 140k.

I don't do that kind of milage any longer, I know the engines are good. So i figured i was onto a winner.

I'll ring CAB tomorrow and maybe Trading Standards.

This guys got my attention now, So he will pay. Can't stand arrogance. I know the customer isn't always 100% correct. However, When i spend £5k with a company, I expect atleast a "sorry". He had no remorse, No apologies, Nothing at all.

He's playing tough cos he's a twp bit amateur. Small claims court will go in your favour. Keep a diary.

He's taking that attitude because the money is probably already spent. Cab and trading standards all the way. Where's he based?

Station house is spot on. Trading standards is the first place to try. They are a publicly funded organization whose remit is exactly to help people in your situation. And it will be the trading standards local to the garage (not necessarily the same one thats local to you) that you must go to.

That said, I once spoke to a very under funded trading standards who refused to get involved with any cases that didn't actually involve criminal liability for the vendor purely because they were snowed under. In which case go to the CAB.

You'll probably find that your local solicitor and the no win no fee people are the same people. From what vie heard, No win no fee is just a pricing structure operated by some solicitors, whereby they give you the option that or simply to pay their bill.

If you get nowhere with trading standards or the CAB, then make an appointment with a solicitor for a half hour chat. They might even do that for free.

Regarding the garage, it really does sound like you're dealing with cowboys. Immediately resulting to calling you names because you've sent them a formal letter, is laughable. They must know they're on the back foot, and are nervious that you're not an idiot and that you're going the legal route.

They advised another letter in light of the phone call yesturday, Advising that potentially he may be in breach of the Consuper Protection Regulations 2008 for advising he "would rather shut down the company than give me a penny for my car".

I've got a TS ref and i think they may be in touch indepenantly with him also.

Another letter, Recorded delivery. Will write that at lunch today.

Sounds good. But really try not to have any phone conversations with him. Do it all formally and in writing. That way you get time to consider what to say and are unlikely to say something wrong, also it's all documented. If this goes to court, you can show them the letters you sent, rather than arguing about what was and wasn't said on the phone.

He will almost certainly change his tune in court, because he would have taken advice by then. He will want to quote (even mis-quote) things you've said though, if it helps his case. So don't give him any ammo.

Not all garages are bad, there are some good ones. Only had my td5 disco 2 weeks and o/s wheel bearing started to rumble and smell hot. Rang them up spoke to the owner and he sai bring it down and ill sort it, mrs took it down today and got courtesy car and they replaced full hub assembly with abs and used genuine landrover part. Ready to collect tommorow. I'm not braggin just saying there not all bad plus it helps how you deal with it

I'm not going to start calling him. I would far rather write everything and deal with it that way, That way i can document absolutely everything.

I'm starting the next letter now and hopefully be able to post it tomorow.

The dealer i bort off made it clear that a refund would never be an option, Untill after i sent an email explaining i had kept records of all communication between us including phone calls... that and the fact i knew my rights.

He refunded to get rid of me

Place i bought mine from went bust 30 minutes after i walked out the door (collected car at 4:30 on a Thursday, they shut at 5 and never opened again)

They had said come and collect Friday - I'd paid a cash deposit and was desperate for the car so went and got it Thursday night - was very glad i did too! Though it meant the few problems they hadn't sorted out never did get sorted as there was no one to go back to, you win some you loose some!

Right, So, This has gone all the way through to court action now. :boxing:

I applied to the court online :monitor_punch:, Waited my 14 days, Then applied for a default as they had not responded. This was on the 23rd, Went on holiday. :beer2:

Forgot about it completely. Had a nice relaxing time and then came home today to a nice letter saying that i'd been granted my default for £5800. Woopie says me! :hug:

So i rings up the company, and get told some odd things, Firstly that she knew about the County Court Judgement and that it was nothing to do with them....

She advised that infact, the cars on the forecourt were not theirs, and infact belonged to several other companies who just rent space and the person who sold me my car was just a broker for several different companies... :Cry: and that he wasn't available to speak to me anyway.

He's going to ring me back tomorrow morning, If he doesn't i shall ring him or maybe take a visit to see him...

Now, I can't find the company on the invoice on companies house. They're on the internet, and have got a various websites and are still trading (doesn't look at all like the lady suggested). I was *NOT* advised that they were a front company for other dealers. The invoice from the CC machine show's it belonging to another company, which i only just noticed. However from further investigation they are one and the same.

Now, I have my CCJ, Which is all well and good and it's against the company which is on the invoice. Problem is that i have nothing to enforce this against.

you will only find the company at companies house if it's limited

if you paid for the car by credit card is it possible to get the credit card to refund? they wont have any trouble finding the company bank account.
