Update Mon 11th:

The incident management solutions have made what I think is a reasonable offer; it covers the cost of buying and fitting of a new chassis. Plus new wheel carrier and door. However, they will not move from cat D on the grounds that it needs specialist repair with parts that are difficult to get.

However, they have said that they will cover the cost of all calls etc - I'll get send an invoice this week which will include the advice from Shifty et al.

Good result! Hope it's back on the road soon! Shame it won't be moved from cat D but at least youl have a galv chassis!
 
That's a good point Karlos: I'm not out of pocket at all and will have a galv chassis, just hope that the cat d label won't affect my future insurance policies.

It may well affect your future insurance, many compnies will not touch write offs and others will load the premium. Stick at them, they are repairing the car so it's not a write off.
 
When I argued (in a mature manner of course) the manager chap pointed out that the cost of the repair was 72% of the value of vehicle. This also makes it a cat d because it is more than 60%.
 
Get the Insurance company to confirm in writing the damage and the authorised repairs. Keep receipts and photos before and after the repairs (if you can get piccies during even better). That way when you renew insurance or sell the motor you can confirm why it has a Cat D marker and what was done to repair it so it should not be a problem. Get your insurance company to confirm in writing that it will not be an issue at renewal time. If they say your premium will increase because of it go back to the the third party insurers and point out that you will be out of pocket because of the marker and will be adding say 10% to your expenses claim to cover it. I dont think they will agree to remove the marker but they may offer a slightly better expenses payout. However it may be one step too far so you may have to settle and sit back in the knowledge that you have a new chassis which will probably outlast the rest of the motor.

Thanks Shifty, as soon as the cheque arrives I'll send a letter asking for re-embursment for my expenses, including time, and a letter for what you described above.
 
Just read all 9 pages and I have to say a big hand to shifty for some stern advice. I have never been in this situation myself and this has opened my eyes!

I'm a firm believer in getting what I'm entitled to. It just takes time and persistence. For every one person that stands up to the insurance bullies (dont forget this is just one of the mandatory taxes that motorists have to pay) there are hundreds of others that just take what they say as gospel and roll over out of pocket.

The law is the law and so long as you stay calm and think about things (no matter how ****ed off and angry you get), present your reasoned arguments along with evidence, they will have no choice but to do the decent thing.

My role in this was just encouragement to stay the course based upon previous experience.

I vote for this thread being made a sticky on how to deal with insurance companies, not just for our pride and joys but all cars and all accidents, when you are not to blame at all....just read all 10 pages and am massively impressed by Shifty advise, indeed all advise..this is what a good forum is about!
 
+1 for the sticky, I have followed from the start and shifty has shown that it is possible to get reasonable offers from them.
 
Hold on there guys - still not received any money so Shifty's good work might not be finished yet.
 
Fri 15th:

Received a letter from the brokers stating that they have requested the agreed amount from the guilty party's insurance company; can't stop thinking that they (insurance coy) are dragging their heels again!
 
Left two messages yesterday and one today on the manager's recorder. Have also sent an email yesterday and today. I intend to maintain this until he answers or the cheque arrives.

Thu 21st Jul

Having been away (with work) for a week I've returned home and still no cheque - what a surprise!

I've been phoning the manager of the brokers everyday from France but alas only an answer phone. So I left a message everyday!

On arrival back at home I phone the brokers again (using the general number) and they informed me that another company (driver assist) claim the agreed amount from the guilty party's insurance company. I asked for the number.

Got through to driver assist this afternoon. The chap said that the issue was in hand and they are still waiting to hear back from the 3rd party's insurance company!

Having completed the paperwork over two weeks ago I'm a tadge fustrated.

I've asked to speak to the manager in order to discuss the issue. The chap said that he would pass the message on and ask the manager to call me by close of business today (5pm).

It's now nearly half five and guess what? Yep no phone call.

And then just to finish the day off my renewal arrived whilst I was away and it has risen from £140 to £403 - are they taking the p!$$.
 
Send a copy of your renewal to the other insurance company and get the to pay the difference! Bastards!

Received a call from the day manager of driver assist this afternoon saying that the paper work was with the third party's insurance. Seemingly it has been there for two weeks! I asked the manager why it was taking so long and she said that it may be a few more weeks before the money is released. I asked the manager for the name and number of the manager of the third party's insurance company but to no avail. However, she did say that she would get in touch with them and get back to me - no reply today!!!!!

This is never ending - I'm starting to hate insurance companies.

I can't wait to put the letter of complaint in when this is all over.
