I don't know the ins and outs but I'm sure you have a case for 'not fit for purpose' or something as long as you have evidence of the 1 year warranty?
Many years ago, before the Internet even, I got a cb750 motorbike from a dealer secondhand, it kept dropping out of 2nd gear but not until the 30day warranty had expired, I went back to complain, bearing in mind that as a family we had purchased 6 bikes, two brand new, over a period of around 6 yrs, and was told to go away, they didn't want to know. I went to cab and they wrote a legal letter of some sorts, dealer still wouldn't budge and blamed me for the damage. Not sure what happened from cab after that, nearly 40yrs this, but they repaired foc. It then went again, same problem and Honda UK sent a tech over who fitted a whole new box foc with a 12 month warranty!
Shame I threw it up the road bending the rear frame and forks and scrapped it a few months after all that.
I think you can do it all online now.
It costs but you can claim those costs back off him if you win which you will??
You'll need strong evidence though like the proof of the 12months warranty and a garage statement of the fault to be sure.

Tried to get a dispute logged with PayPal for a refund on the FIP which I'm pretty sure is dead. PayPal says no, I have 180 days from day payment is made, but only 30 days after delivery, so I had 30 days to report the fault. By the time the fault appeared I'd missed the window and it seems Charle's year warranty is as much use as a chocolate fireguard since he won't make contact. So yay! 1,500 gone and I'm in a worse position now than I was with the original pump, at least it drove while dropping fuel everywhere. Now it just drops fuel everywhere.
Name & shame the seller on here & all social media you can access.

Unless you can prove the FIP is faulty with, for example, a print out of fault codes, you are on a hiding to nothing. If you can prove the FIP is faulty with tangible evidence, the small claims court is the way to go.

My parents had a similar issue with a Hilux a few years back, had been sold with a cracked head but with some crap in there to hide it. About 3 months later it started blowing coolant pipes. Guy was a family friend where I did my apprenticeship as a mechanic, refused to pay a penny. Took about a year for them to find a solution to that. They were still out about a grand in the end though.
Working through all of that now, want to ensure everything else is absolutely tiptop before I start pushing it higher. Although to be honest, I just want the old girl fixed. Had her 14 years, don't want to have to scrap her now.

Only way I can think to prove it is the fuel pump is to have it tested by a specialist.

Could you drive the car as far as Bucks or is it pretty much knackered?

Credit card, debit card or bank transfer to the PayPal your end? If it was credit card then get onto them for advice or backup. Always worth doing £100 upwards via credit card for the extra protection usually in the small print.

If I can get her going, she'll unhappily cruise, but taking off from a dead stop, or hills. You need to get out the calendar for 0-60 time. So Bucks is a bit on the far side. I've been given the contact details of a place in Bristol, so I'm calling them tomorrow, to see if I can sent them the pump for test and if it is repairable, what I'd be looking at. I'd probably send my injectors to them for test too, just in case there is any contam in them. I took off the top cover and there is a lot of black sludge in there. Need to try and trace how far back into the fuel system it goes. Weather chased me off today.

I always have PayPal setup to take funds by bank transfer. They've told me to contact my bank to try a trigger a refund, so I've got them to call on Monday. Hopefully they are sympathetic. Been doing it so long, I forgot sometimes bad things happen online.

serviced the P38 today but while I was in the engine bay I took the intake manifold off and changed the glow plugs and spill return lines. Had noticed a puddle of derv by the injectors.

All sorted for another year.. maybe 6 months depending on mileage.

I looked at my spill pipes yesterday when I had the inlet manifold off, still perfect. It is the Gates reinforced stuff that isn't smooth but textured, dimpled surface, a bit like a golf ball.

Black sludge doesn't sound good. That could certainly mess things up.

Opening the top of the FIP before it has been inspected might have been a tactical error.

Snowed here again but melting reasonably. Traffic reports look like chaos so suspect I'll be digging Otto out of his cover for the trip to the chiro and BILs today, just in case. The fusion spins the wheels far too easily just in the wet. Let alone ice and slush.
If you don't use the 4x4 in slippery and flooding when do you?

Black sludge suggests bacterial growth, in which case you will, at the very least, need to add anti bacterial additive to the tank, worst case the tank may have to be cleaned. The black sludge would certainly account for some of your problems.
