    See if you have the sediment filter thingy first, you may not. If you do, drain it and see if there is any water. Water and diesel don't mix so it will be fairly obvious.     Depending on the model you may have a sediment filter under the chassis in the rear which could have been submerged. It shouldn't have let water in, but it may have. Pop the little bleed screw out of it and drain it, see if there is any water in the fuel.

    I totally understand, but I just wasn't aware. I just presumed that if a van was insured by the other person for non-commercial use then I would have thought that it would be classed as a car and therefore I would be able to drive it.

    But in answer to your question, yes you can replace it with a Discovery one but the cable and mechanism is different so there may be some fettling to get it to fit. Never actually fitted one myself but it's probably not that difficult.

    It's a very simple mechanism so it's going to be something very simple causing it to bind. In the top there is a plunger type cam that pulls out when you apply the brake and pushes the pads out into the drum. Make sure this part is clean and well greased and that should be it on the drum side...

    I doubt that the vibration will be an MOT issue as they don't take it up the road. But get it sorted as it will eat the UJ's. As said above a double decardon prop from a Discovery 2 will allow for the increased angle from the transfer box to the front axle.
