Ive done loads of these cases so dont worry !!!!!

First the bad news,

The dealer who is selling you the new car are well within there rights to cancel the deal, However the deposit should be fully refunded to you as a gesture of good will, Most motor traders have come across the matter of outstanding HP and to be honest i bet 40% of any dealers stock has some finance yet to be cleared.

The dealer who sold you the present vehicle is in deep water, The law states that any finance agreement must be paid in full BEFORE the goods are sold and full title is then given to the new owner, Because they sold you a vehicle without paying off the HP a FRAUD has taken place, this is simply down to the fact that the seller has deprived the finance company of there goods without paying for them in full, Its really a form of basic theft.

The good news,

Due to the time that has passed from you buying the car and then discovering the outstanding finance, The vehicle is now yours under the law as you purchased it in good faith and have kept a valid reciept.

With regard to the back-street dealer, it is upto the finance company to persue them for any monies due under the finance agreement, and as for the garages attitude of "when we get round to it" well thats there problem and not yours !!!!!.

The finance company can remove the debt from the HPI register, i would be as helpful as i could be with them due to the fact that if this matter ever goes to court then they usually pay around £600 for you to stand as a witness for the prosecution !!!!!!

Trading standards are a fine bunch of people but only like making phone calls and the odd letter, They will always refer you back to sort it out with the finance company.

If you get no joy from either the finance company or the back-street garage then i would let the police be aware of this matter, Finance companies hate the plod looking into there businesses and sontimes the hint of a police investigation gets things done a lot faster (know what im sayin;) ).

On the bill of sale from the back-street garage, does it state the following ?

Date of purchase
Purchase cost
Payment details

Also are they members of any motoring trade organisation ?????

You state you paid in cash, was that in cash notes or a cheque ? Did you have to draw this money from a your bank account ? if yes, can you get a bank statement with this transaction listed ?

My next doors have parked a caravan in my garden ,I said they could ,but did`nt realise it was going to stay for so long....

They did ask me , but now I realise they cannot possible fit it in their own garden ,which was the initial agreement [after they chopped a tree down]...

They come in cleaning it etc..

Shall I just torch it...

That way causing little friction...

Traggonely car , surely the back street garage acted illegally or can anyone do that...:confused:

With regard to Treworgey90 and his car, It is illegal to deprive a finance company of its goods, its not illegal to sell the goods first as long as you inform the HP company and pay them in full asap after the sale takes place:D

I don`t think they did their measurments and don`t want to get rid of it ,so it lies in my garden getting mouldy...

A letter is a bit ,well ,cowardy....Maybe I should advertise it in the local shop with their telephone number on it...:D

Yes, the bill of sale states all of the above.
I don't know whether they're members of a trade organisation - I doubt it and there's no logo on any of their paperwork.
I paid by electronic transfer from my bank account to theirs, and yes I've still got the bank statement showing this transaction.
I don't know how much is outstanding, the Finance Co. wouldn't tell me that.
The vehicle is a Mitsubishi Shogun, which I paid £20k for - £8.5k Part/Ex for my old Hippo and £11.5k cash. The Hippo was a dog and had HGF at the time - I think they lost money on it, that's why they aren't keen to help me.
 
yup and yup in fact i had 2 gaylanders for 2 years each - that's why i bought a shogun
Of course, it's me deepender that's me first love - the shogun is just (reliable) transport
 
why dont yer just drag it into the street and leave it there ;)

They do have the power to ,lets say inconvience me some what and who want `s to be on neighbours from hell...:)

But they bought a house with a window box as a garden , I suppose it`s their problem...What is anoying they want to invite friends to come and stay in the bloody caravan...:confused:
