The very good times and the very bad times (My first few days of owning a landy)

Does not make any difference where it was parked over night as long as it was legally parked as you are claiming from a 3rd parties insurance. In this case it would not make any difference even if you had to claim from your own insurance as the question insurance companies ask is where will it usually be kept overnight, not where do you keep it every night as that would be ridiculous. If there are people out there who think that their cars have to be kept in a certain place every night in order for it to be insured then they need their heads checked and if they have believed that when an insurance company has tried to get out of paying out then they should be put down. Does no one check their insurance documents?

As stated his insurance cannot write it off but they will try!
 
If you check the stipulations of insurance the car is not expected to be permanently parked outside your home merely that most of the time it is. There's a certain number of nights it can be parked elsewhere but how could anyone check.

Doesn't matter anyway as old man and his insurance have accepted full liability they must repair or replace your vehicle to a level at which you were before.

My sister was recently shunted by a bint in a z4. Wrote car off and my sisters back is a problem now. Sisters car had a plate on it. We got that back and Dvla had to put a plate back on it. They have it a 2001 plate which it certainly wasn't so she got £1200 for a car that was scrap value at best. Now she is driving a 2001 scenic and very chuffed too.

pre warned is pre armed me old mate - ok.. as I previously said.
each year my insurance renewals come with additional new sub clauses,
its premium never goes down, only Increases.
for years I have had 2 fully discounted Insurance polices running on 2 seperate vehicles.
but each year, the addendum pages get more & more.
the worm wriggles more with each year, while my full no claims discount can no longer increase past its already maximum(s)
 
looking at the origional pic, the landrover appears to be parked totally blocking the pavement .... i think thats actually illegal. if it had been parked fully on the road probably the old guy would have noticed it and not hit it.
just be careful, dont send the insurance co any of your pics , tell them nowt they dont ask for. and be careful how you word anything you put in writing.

"it was parked at the side of the road with two wheels on the grass." is accurate but vague and better than "it was parked on the pavement with a bit sticking out over the road."

Hmmm I didn't think about that, I think everyone parks over the pavement down that road and people now know to just use the pavement the other side! Either way the policeman didn't mention anything about where it was parked, and I think even if it was parked fully on the road he still would have hit it, you really can't miss it either way it's a straight, flat road and at the time the driving conditions were perfect. :)

Got a 3 litre toyota hilux double cab pickup as the courtesy car which is quite cool :cool:
 
Some people find them very good others don't, I for one wouldn't use them after what they did to red

Bear in mind Adrian Flux is not an insurance company (as in underwriting policies) but actually an insurance broker.

When you take out insurance with them they will put you with the cheapest member of their panel of insurers so when you make a claim you could be dealing with Axa, Norwich Union, Liverpool Victoria, RSA, Ageas etc which is why experiences vary.

I'm sorry but the fact that the guy had been asked twice not to drive already proves his liability, he's considered a danger to others given that he cant see properly.

I would think that due to this alone it completely negates that fact, that and he obviously hit something that was very visible given that the first car goes by without hitting it

so, the guy at fault (no question of blame)
has been previously asked the give up his license,
does that make his Insurance Invalid as he was acting in a manner contrary the direction of a policeman?
the policeforce in question being held accountable for the errent drivers actions
(oh ****e - not another fanny type rant coming)

or just let matey now driving a loaned 4X4 get on with the tedious task of form filling, phone calls and expected truamas post accident...

Not sure on that, I'd think unless it was official rather than a "hey just a thought but you might not want to drive" it would be ok insurance wise
 
If said man had been asked not to drive [ twice ] sombody is responsable for not removing
his licence on the first time he failed eye test / or notifying the dvla ect .

Wow you must of been in shock , hope you had a large brandy!

Jesus how unlucky is that , I really hope it gets sorted it looks fab like the others have said if you get a galvanised one wow you really will have a sorted landy good luck keep us posted :)

Numerous acoholic beverages have been consumed since then but no brandy i'm afraid :rolleyes:

Any way just a little update, the insurance company haven't had a look at it yet, I wish they would hurry up and arrange something already :mad: I guess this whole process is going to take longer than I had hoped.

We got the landy up on a ramp to take a look, the axle is bent and the chasis is twisted, some other rod things are bent but I cant remember what they are called :eek: also rear crossmember is bent, wheel arch and the panel around it are wrecked and would need replacing, the diff is weaping oil and the wheel is buckled. Because the car that hit it was so low it looks like it has gone under the rear bumper on the landy and the wheel has taken the brunt of the hit. To be honest I kind of hope it's a write off now, I could spend a load of money fixing it up but who knows what kind of damage the shock from the crash might have done to the rest of the car, like the gear box and engine.. It could never drive properly again.

I will probably buy it back just for the spares anyway.

Thanks the others were probably anti roll bars but your not intrested in that well if you do are waiting hope you have been supplied a car :)
