I think not all Disco 1s had it fitted, if not .......I thought that if it was factory fitted, it needs to be on the vehicle.
MOT might be interesting

Just googled it and you're correct about removing it.If the ABS has been intentionally rendered inoperative, the whole system must be removed. This does not apply to sensor rings or other ABS components which are an integral part of another component, such as a brake disc or drive shaft.
It is debateable whether it is a safety item. The brakes would be the safety item!Just googled it and you're correct about removing it.
I find it amazing that a safety item can be removed and isn't picked up on the MOT.
I wonder what would happen in the case of a fatal accident?Just googled it and you're correct about removing it.

They'd still have to prove that the brakes didn't work and that the MOT was false in some way.I wonder what would happen in the case of a fatal accident?
When the vehicle is inspected and it comes to light you have removed it then maybe some uncomfortable questions would be coming your way?
No. It is perfectly legal to remove so long as you conform to the rules. Ie fully remove and let your insurance know. At the end of the day there are still plenty of cars used daily that do not have ABS.I wonder what would happen in the case of a fatal accident?
