Ebay rejected the case out of hand as I did not take photo's. I'm aware of the Consumer Contracts legislation 2013 and am taking action via Trading Standards.
Ebay are more interested in protecting an established seller than the buyer in my experience because the sellr is where their income comes from.

That is really quite odd. I've never had to take photos. Recently had to do two separate returns, both because of wrong colour. No photos asked for.

Well, after weeks of pushing this around, Paypal said I'm entitled to a refund one day and then a couple of weeks later they have changed their mind and said they will not refund blaming the tracking number even though I have an email from the seller confirming the seats have been returned.
No credit card involved so no come back there.
I have been in touch with Trading Standards, they have made 3 visits, but Mr Skitt is never there or is hiding.
So it's a total loss for me and the seller keeps my cash and the seats. Last time I buy anything of value on Ebay, I'll stick to the odds & ends I buy that can be written off if the deal goes wrong. As for Paypal, I will use my credit card in future.
I'm looking into the EU agencies that pursue these cases.

Look it up its worth a go you dont need to even go to the court even if he decides to defend him self some one else can who is uk based. Iv just sorted an issue for a mate chaseing money owed by his employer they got the court papers and paid him within days.

It seems that positive feedback on Ebay means nothing.
I posted 3 lots of negative feedback for skitt55-2008, 2 items not delivered, 1 item refused as not matching the description, the feedback does not show on his feedback record. It seems that in the case of non delivery or a dispute, Ebay erase the feedback, so a seller may have a bad record for non delivery or disputes and still have 100% positive feedback. Seems to me that makes the feedback system a bit pointless.
 
Looks like I'm about to be stung again on Ebay, just had this message about another purchase:-

"We had to remove this listing from the site and you're not required to complete the transaction. If you've already sent payment, the sale should process as normal and you don't have anything to worry about. If you have any questions about delivery, please check tracking or contact your seller. If you run into any trouble along the way eBay is here to help. Please visit the Resolution Centre to help resolve any problems you may encounter".

It seems Ebay is no longer a safe place to do business, I found buyer protection worthless.
 
Have had the same messages on stuff before. Sometimes eBay wants to remove a seller because the goods are dodgy/illegal/counterfeit.

I got my item, it was as expected and fine. I had paid, but could not order another one.

Would it not wait until all of the dispute is over before allowing it though? Lets say someone gave a negative feedback and raised a dispute but it came out in favour of the seller. During that time they would have negative feedback which could effect sales and their rep unfairly. I know this isn't the case for you but that would make sense from a neutrality point of view.
 
I'd be tempted to go after PayPal.

They have "safe" written on every single email they ever send out - I'd want to know how you fell foul of their policy, and go from there. Ie what small print they are using to get out of the claim.

If they can tell you, well that's that, but if they can't tell you....

I have no real idea why they rejected my claim. They actually said in writing I was entitled to a refund then refused a refund on the grounds they didn't have a shippers return number, even though I had the sellers written confirmation that his goods had been returned.
They seem much more interested in protecting sellers from whom they derive their income than buyers and they seem to ignore the Consumer Contract Legislation 2013.
My only remaining option is the small claims court which it seem I can use on line.

I on a couple of occasions have had issues with smallish sales (£20-£30) not delivered, or wrong items delivered and after starting up a dispute have had the cases found in 'my favour' and refunds given with no problems.
 
You should of accepted the items then returned with tracking number that way PayPal will refund. I bought £2800 amplifier from Italy that didn’t work properly, seller refused refund but because I had proof of postage, they refunded after 28 days.

Sometimes I wonder how they get away with it. You have them bang to rights and they hope you'll just leave it because it's too much hassle.:mad:

Two P38 seats take up a lot of space and cost a lot to return, as they were not as described I didn't let them off the van as I have been caught before with return carriage costs and still had to fight for a refund which did not include return costs. There was no time to take photo's the delivery driver was not about to wait while I found a camera, he was annoyed at my non acceptance. Ebay eventually rejected my claim out of hand, no photo no refund, ignoring the consumer contracts legislation. Negotiations with the seller & Ebay took so long that by the time I went to the Paypal disputes procedure, evidence like return numbers had dropped out of the system as had photo's of email's from the delivery agents advising the seller his seats were at his local depot for collection and asking for payment of the return carriage. It's unlikely the seller didn't collect as even after paying the return carriage he was £20 in profit and would have the seats to sell again.
Just had another Email from Ebay saying that a site I bought a small item from has been compromised so I may not receive what I paid for. There are a lot of fake sites now on Ebay, it's becoming a dangerous place to do business, one I will avoid as much as possible in future.
