Bad Used Car Engine from - (Still Waiting For My Money Back)

Dear all

This posting is a small 'shot across the bow' for a used Auto Spares company
in S Yorkshire, vicinity of A1(M) JCT37 and M18 JCT4.

I was looking for a used but good 1.7 16v engine for my Alfa 33 - they
called me with 'a good one, 48k miles from a 1993 car' delivered and with 3
months warranty. Duly my credit card came out of my wallet and it was
delivered to my home.

Well, it was actually a 1990 engine (in the casting that they'd tried to
hammer the '0' from) and apart from the rusty valves, when I'd fitted it I
topped all the levels up and, yes, the coolant actually poured from the crap
cylinder head gasket.

After writing letters and making numerous phone calls, this company won't
make any committment to a refund and collecting the engine. Any 'possible
dates' for collection of the engine have passed. Still I have an engine
that isn't fit for purpose or as described.

Well, If anyone from the 'used Auto Spares' business reads this, your
company info is on its way to me from companies house (because your trading
name isn't your ACTUAL name) and if I don't get my money back, these guys on
these newsgroups will be the first to hear your true identity. But only the
first.

You brought it with your credit card? Let them do all the work - they =
*should* refund you the monies and chase the seller.

Would the address be something farm?






 
The credit card company may be able to assist you. In any case They should
be honerable enough to make good the claim they made

So, do you work for them or have you had good/bad dealings with them then?

Sue them. Its very simple these days and the action can even be
started online


 
Probably wrong newsgroup...as we are mostly into vdubs...but at end of day,
can you not name them anyway ( I used to race alfasuds). If they provided
crap service, nothing changes that, so they cannot do you for slander. (take
digipics of problems...will always help in court)

I agree that you ought to threaten to sue them in the County Court. You can
obtain the necessary paperwork from your local court and it comes with
explanatory leaflets. It is quite likely that once the seller is served
with the court documents he will pay up without a fight.

If you do go this route you should give the company a definite date to
rectify the matter after which you will initiate proceedings and you MUST be
prepared to do so. Perhaps you should also seek advice on the uk.legal
group.

Ah, but the engine is a opposed 4! (water cooled though....)

I've done the pictures already, but if it all goes badly pear shaped, I will
simply state my dealings with them - others can draw their on conclusions
from how I acted and how they acted with respect to the purchase of an
engine that was mis-described and defective.

Did I mention that they also debited my credit card twice?

Had dealings with them found them very average, and a little expensive, but
they had the bit i wanted, and it was in good nice, just needed cleaning

As has been suggested, all you need to do is phone your credit card company.
They will send you a form to complete, you'll get your money back.

It's really simple, so just do it.

You'll have to be quick. Dodgy businesses like this usually dissolve themselves
when something like this comes up against them, so you've not no
company to fight against and get money back off. They'll probably restart
themselves under a different name, and get a different monkey to be director.
Its a common loophole that crooks use unfortunately, and one I've been a
victim of.

In this sort of case then ask some advice and see if you can initiate
liquidation proceedings, they can't just dissolve and reform, they have to
pay off all claims and liabilities and a court liqudator disposes of the
assets. they're sunk. and if they're the dodgy sort, they'll be near enough
the edge to go this route.
