'Sports Exhaust' (silencer removal) MOT Failure?

As per the title , do the largely advertised 'sports exhaust' with straight through pipe now fall foul of the new MOT rules? My D2 TD5 is due a new exhaust and I was tempted towards one of these but not if it is an MOT failure.

Ask the vendor, some will give a guarantee some won't, if it does fail then you better hope you bought from the one giving you an MOT guarantee.
 
Does it have the right number and type off features fitted? Silencer, cats, filters etc as per original factory eggsause?

And the bigger question would be how does it make a D2 into a sports car. If it does yer'll need to upgrade the brakes and fit parachutes.
 
There has always been a MOT fail with exhausts if...
A silencer in such condition, or of such a type, that the noise emitted from the vehicle is clearly unreasonably above the level expected from a similar vehicle with a standard silencer in average condition.”
