Someone reversed into my Range Rover!!!! :-(

ive had this before some insurance companys will try and get out of it by saying as its in a carpark its not coveredand its a civil dipute works well if you at fault but as not your fault could be hassel for you

had a prang in a carpark once when a opel manta driven by a foriegn gentleman reversed out of the parking space, my audi plowed through his rust bucket with minimal damage! but was still a write off.. insurance paid up no problem:D
 
lol, will post a pic later, the stupid bitch came off worse her wing was re-shaped to the shape of my bumper lol - im just hoping that she is found liable and i don't lose my no claims and have to pay my excess.

I wrote my Discovery off last April, not my fault woman pulled out in front of three of us and I was the one who hit her. Anyway, come to insure my new Rover 75 and the premiums are beyond a bloody joke. The case is still pending, and they are still trying to get their money back, even though I was not at fault it has forced me to take a personal injury claim out. So beware with insurance companies, as the spirit of Dick Turpin is alive and very well. Oh I also lost my excess aswell.

Bloody hell Matt. Don't take any crap about it being your fault etc. Happened to me in my VX220 an it was written off. There was a case of a 50/50 but as I was stationary etc I got my noclaims back......... Granted after 2 years. Try using a company called Help Hire. They will do all the fighting for you. Don't think you need to inform your insurance if you use them.

:5biagree: My wife used HelpHire when she was in an accident, they are excellent and provide regular updates on what is happening with the claim.
 
Helphire are great. They will get you a like for like car while yours is being repaired matt. I got a brand new Alfa spider convertable which I had for 3months. Fortunately I never had to actually own the alfa but got the true alfa experiance while I had it. Lol
 
a carpark toi which a member of the public would normally have access (I:E supermarket pub etc) is classed as a public highway under the road traffic act and all laws relating to a public highway also relate to the carpark. only exceptions to this are private carparks on private housing complexes and private clubs, company carparks etc.

Dude its so easy to google stuff about acts/regs/legs and make your sen sound really clever, but when it happens to you youl know its not as simple as that :)
 
I did the same to a guy many years ago when I was driving an old sierra estate. I honestly didn't know i'd hit him as I reversed out of my space.First i knew of it was note from the old bill through my letter box when i got home that evening. Copper said that the guy had given him all the details and if I made contact and sorted things out, then he wouldn't get involved. I i didn't, then he'd be back!
Contacted the guy and met up, and sure enough, a scuff on my front bumper matched up perfectly with the scrape down his door (even had a bit of red paint around it). It was fair cop, so gave him a couple of hundred to get it sorted (he did get an estimate first) rather than mucking about with insurance.
If she doesn't come clean, then try talking to the old bill. You never know, you might get lucky and they'll show an interest. Good luck!
 
i would doubt that was from google, but he is correct an insurance company cannot override the road traffic act just to suit their ends

Humm im pretty sure that was not mentioned? They may not 'override' traffic acts but they will do everything there is to do before coughing up thats for sure!

And when I first passed my test. Some ****er in a volvo reversed in to me fiesta. and drove off. Fortunately for me the carpark I was in had cctv. and not only did his insurance pay out for the repairs but the prick was done for failing to to report an accident. and driving without due care and attention.

He tried the "it's a civil matter because it was on private land" but Plod soon put him right.

Before you go through insurance, get a quote for repairs and see if she will pay for it.

It may be in her interest to do so to protect her NCB and excess and it will save you a lot of grief for the next 5 years (and probably expense too)when you apply for insurance quotes and fill in the 'details of previous claims' box.

I have spoken to my insurers and if liability is found that it was her fault, it would not affect my NCD or any thing else.

It may not affect your NCD, but you will thereafter have to answer 'Yes' to the 'Any claims in the previous 5 years' question which automatically loads your premium...

Erm no that only happens if the claim was against you.?? otherwise you answer no because you haven't had any insurance claim against you. It's why Insurance companies are so quick to settle claims with a knock for knock agreement. cos then both parties get screwed for higher premiums.

The question usually ends with 'regardless of fault'. I was stiffed with this when I first started driving and someone hit me although that was quite a long time ago.

The theory is that someone who has been involved in an accident is more likely to have another one. A stupid flawed theory, but one they seem to use. You can't argue with statistics apparently.
