i am just trying to work this out because i was informed it was a trade sale, and my receipt shows a business address, however, the guy has basically told me to do one and that it was a private sale (after i advised to sale of goods act) and hed been using it as a run around for a few months even though the V5 shows a completely different name and address??? thoughts???

ermmmm sounds a bit dodgy to me... im no legal expert, but i did sue a small car garage that sold my ex an utter heap of a freelander 1 and I won all the money back... Is the business address for a garage?

Does your receipt show VAT?

It's known in the motor trade to offload problem vehicles in auctions. Garages/retailers etc often sell private to do the same, if they're a small outfit or one man band. Search online for his phone number to see what else he's selling, or sold in the past. The relevant authorities would want to know about someone selling private whilst in business. Also if it's unsafe (fire hazard and brakes dangerous) the relevant authorities would be interested. Normally these types of people know how to navigate the rules and do so to cover tracks. Don't use Halfords. Find a proper local garage to check it over for you. Fighting the seller will always be difficult, more so if private. Hopefully it's quick fixes. Unfortunately you have made some mistakes. You should ask to see the log book before buying, and sellers ID. If you don't know about cars/mechanics then you should have taken someone who does, or paid for an inspection like the AA. You could go and see the person on the log book if you have contact details but if he said he was selling for a friend or it's part ex then alarms bells should have sounded.

yeah life lesson on this one.... its only the second car iv ever owned and the first one i had a friend come with me, but this was all done on me todd like the idiot i am.... i wont be using 'halfrauds' again on this, i have spoken to a local garage that will be taking the car tomorrow, hopefully.

He advised me it was a trade sale, and my receipt is a trade address but hes now saying it was a private sale.

If im honest, i signed the log book and didnt check his details and that was my error. who should i be contacting on this???

the good thing thats come out of this, is i now know a lot about cars, about buying cars, and also about what to look for and the like so swings and roundabouts i guess..... but sadly i didnt have anyone to do such checks and i didnt even know the aa did that, so now i know.... havent owned a car for 6 years as not needed too down in london so life lesson on this for sure.... thansk for this advice ....

i say privately, my receipt clearly shows a trade address ? it gets worse .... royally been screwed over on this

If you want to claim in the small claims, from what i can remember you have either 3 or 6 months from purchase date.

As Hippo says getting any come back from a private sale is much more difficult but if it is a trader that's pretending not to be anything you can find out will give you more leverage at least.

thanks for this.... apparently so ... i am realising fast that i screwed myself over on this.... my receipt (no vat) shows a trade address, but hes now saying it was a private sale and hed been using the car for a few months prior to selling, but told me it had barely been driven since he had it as a part ex - i did the checks i could think of, but no had a car in 6 years and was on me todd as noone to help and well i didnt check everything thoroughly enough ... i even joked with him that if it broke down i knew where to find him and 48 hours later than handbrake failed.....

so much stress

they really do - its a shame honestly and just common decency just flies out the window when people want to make a quick buck at the expense of an unsuspecting person that needs a car to get a job .... arghhhhh ... i have to laugh about it ... else id be wailing in a fit of despair .....

you should be able to get free advice from a local solicitor... see what they say about it...??

I would say if you have a receipt (regardless of VAT) made out on headed paper, this is enough for you to have 'believed' this is a trade sale at the time of purchase and that your basic statutory rights were being protected under the Sale of Goods act....

Fanatic is a bit of a legal genius, might be worth contacting him for some advice....failing that contact the Office of Fair Trading and/or CAB to discuss.

Its not dangerous. Its just sh1t.

Its the buyers responsibility to verify the car is as described. If the seller deliberately mis-described the car you might have recourse, but proving this is practically impossible and always degenerates into a he said she said stalemate.

Sadly, a fresh MOT is literally worthless as an indicator of a cars condition. Ok, it will tell you the floor is not hanging out but it tells you nothing about reliability, most engine issues are not checked at all, very little electrical stuff is checked and there is nothing to say that the seller didnt remove many components that passed the test and replaced them with worn ones the day after the test.

You havent told us what engine it has. Given the mention of headgasket, I am going to assume its the 1.8. These engine are notorious for head gasket failure. Often this is not justified and many garages misdiagnose other problems as head gasket failure because "they all do that." If its fixed PROPERLY and the rest of the cooling system is maintained properly it should outlast the rest of the car.

A "huge leak"..... oil? water? sand?

The electrics "keep going". Where are they going? No, but seriously - you will need to be specific.

windows dropping - likely snapped cables. Ebay has replacements. It takes someone with a little skill half an hour to fit.

leak from the door....check the door seal isnt torn. Also, if someone has been fiddling with the window mechanism they might not have refitted the plastic sheet behind the door trim which could allow rain water to leak into the interior.

non starting and needing a jump...probably the battery but get it checked. Any motor factors that doesnt have Halfords written above the door will be able to test it for you.

You need to get this car looked at by someone who knows what they are doing with Freelanders. Here is the thing.....thats basically a fairly minor snagging list -ok the head gasket could be a big job- but God knows what state the transmission is in. Freelanders have a transmission system that requires careful preventative maintenance or it will catastrophically fail very quickly indeed. In fact, given the state of the rest of the car it might be already too late - I would say there is a fair chance your car doesnt have a propshaft and is no longer four wheel drive.
