Getting yer money back

Hi all ,well had my TD5 for 2 weeks now still got no further on with missfire and engineer as been back today to check more things on the bloody thing and guess what still got the missfire. engineer did Hint he knows what it is but Does not think Dealer will pay for it TOOOOO expensive.
So I have given them until the end of the week to get it sorted out or at least know what the problem is with a date of completion for the work to be done. if not I need to get me money back ,So if there is anyone out there who as had to get the money back from a dealer any tips you may have to make it as painless as possible will be greatly appreciated.

You should have got a TDi mate.

Tell us all, how do you know it's missfiring, what are the symptoms.

CONTACT YOUR LOCAL TRADING STANDARDS they should take it up for you and the dealer might be more inclined to sort things as they have the power to prosecute under trade descriptions act.Also put everything in writing and keep copies.

......plus sale of goods act (I think it applies to vehicles as well....?),must be fit for purpose sold.I had trouble with a dealer with a 200tdi which turned out to be held together with phlegm and underseal,I stupidly sold the vehicle on honestly for the value of the fine engine.The dealer did the same to someone else at the time ,they went to trading standards and got an out of court settlement that they were happy with,but they'd have won the court case apparently but didnt want to wait for it.The trading standards people I've spoken to love to take court action on bad traders.Do it mate

Had this problem with a car.

GOODS NOT FIT FOR PURPOSE.

They do not have to give you your money back but offer to put it right.The best thing you can do is reject the vehicle and ask for another.I did this and got one with 20k on the clock not 50k.They wanted more money but i refused quoteing local papers.
I said "money back or decent car please"
I paid the full amount in cash and they said we dont have that sort of money and we dont have to refund.
After refuseing to leave them alone finally got a decent car outta them.....
I will stick to private sales in the future.at least you know where u stand.
Give em stick after all its a buyers market at the moment.

Do you have credit on it if so call them and tell them the storie and say its not fit for use and lay it on with a trowl, as they will pressure the company to fix it, also ask how long you have to return the car as you dont want to pay your instalments if it dont work

thanks everyone it lokks as if i will be getting my money back not heard a whisper since the engineer came out on monday. have conatced the trading standards who have advised me.Said I must allow them to offer a repair first as the car is not dangerous , if they cannot sort it within 14 days I can ask for my money back as it is not fit for purpose.

will let you all know the outcome in 14 days time.

I am NOT defending dodgy dealers here but I do think sometimes you have to look at these things two ways - there is also something called buyer beware

if there is something that seriously wrong with it why did it not show up on the test drive and you pre-purchase inspection?

its always best to have an independent inspection by someone qualified BEFORE you part with your money

one very important thing - whatever you do, don't leave it past 28 days from purchase as the area gets greyer the longer you leave it

and as advice for anyone - make sure you get the dealer to record the mileage at the point of sale, otherwise they can claim wear and tear if you take it back a few hundred miles later

before you go running to trading standards, have you actually tried talking to the dealer? I know it's probably a long shot but some are quite decent

if that fails then contact trading standards, but whatever you do, don't loose your temper with the dealer or you'll find it much harder if it goes as far as court

Most dealers are "open to suggestion"as far as where you put you toe!
I had to spend a fair few hours with the one i was traded to by.SO as a result they were OK because its a small world,When it comes to it they are dealers by there nature so thats what they do.It is very rare that there are serviced vehicles on the fore court and yes they had an oil change!.Most dealers dont know **** all about mechanics and just wanna make money selling finance packages so a customer that knows their rights and also mechanics ought to be able to select the right vehicle with a little faith towards the seller.
When useing dealers its best to remember that they know **** all about cars mostly and your on your own.
