P38A Can you take your car to another MOT station if it fails?

I've used the same local garage for MOT's for several years to test both the RRC & our daily driver, at a cost of £40.
I normally have them tested up to a month early is case of a failure but todays VOSA system I believe makes it an offence to drive a 'failed' vehicle even if the original certificate is still valid - can anyone clarify that point?

The driving for the defender is about 3-4K a year mix of prob 25% of journeys more than an hour and the rest under.

That's what my mot man told me - you can take it early but if it fails it overwrites the existing ticket

Mot station attaches copy of emissions test result to his paperwork and types in pass / fail on the vosa site.

As Adam says, this guy is having a laugh prescribing a new exhaust, and if he was half decent he would advised you to take it for a blast and try again

You can take your vehicle away if your MOT certificate is still valid.

If your MOT has run out you can take your vehicle to:

have the failed defects fixed
a pre-arranged MOT test appointment

In both cases, your vehicle still needs to meet the minimum standards of roadworthiness at all times or you can be fined.

Thank you for that website info. which gives total clarification on the legal position.
Like many of us, I suspect some garages are interpreting the 'rules' to suit themselves & raise revenue as a result.

Thanks for all the advice guys. The car totally failed on emissions - so badly I simply don't understand how it passed the year before. I had the whole system replaced with new (non OEM) including 2 replacement manifolds from a breakers as the old ones were so warped. A costly pre Christmas venture. the old system was the original and leaking like a sieve. The new system has a slightly increased woofle which is welcome. Had I known all of this would have happened in advance I would probably have had an entire system built up by SS. Ho hum.

When you say it failed on emissions what were the readings ? if you have replaced the manifolds are there leaks from the gasket face or down pipe ? If so leaks will screw the emissions readings. also if there are leaks before the O2 sensors then they will mis read resulting in adjusted fuel/air mix. which will also screw the emissions readings.

My Porsche failed earlier this year following a clamp not torqued up which allowed the gasses to escape, resulting in an emissions failure due to the escaping gasses giving a too lean mixture reading.

you should have an emissions print out. what are the results on it ?
