2004 Freelander TD4 - won't go over 70mph

This is my first ever car, at first I had a significant amount of black smoke coming out the exhaust everytime I accelerated, it crawled up hills and wouldn't go over 70mph. Diagnostics gave me Error code - P0046 - solenoid on the actuator.

Since this I have changed the crank case breather, which has reduced the black smoke but not improved performance at all. I then replaced the boost solenoid, this has helped acceleration slightly and again reduced black smoke but I still can't get over 70mph.

The turbo is still very loud like a whistle or a dentists drill. Previous owner replaced the turbo in the vehicle before selling to me. Any ideas on what to do next?

Doesn't appear to be any holes in them no, but the air intake hose looks a bit worse for wear, no holes but looks like it's not sealed properly could this be the issue?

No, the air intake hose allows air in and so could be removed and the engine would still run OK.

Good inspection of all turbo and intercooler hoses on all sides would be worthwhile.
