It would appear from reading this, that it is up to the tester to interpret the regulations, it could be that one tester will pass it, another might not.

I am sorry if you seem confused, but in essence what I am saying is that the rust as been accumulating over the years which was never picked up at the MOT over said years, was it actually part of the test or not, in other words was this so called fail a fraud.
