Or go to a solicitor, my wifes a teacher and she gets 30 minutes free advice through her union. Do not hand the car back without knowing where you stand legally.
 
I'm gonna have a chat with CAB tomorrow. Though they usually just do the 'consumer rights stuff' but don' know if they'll delve into the nitty gritty details. If I don' feel satisfied with their response then I'll see a solicitor.
 
No way he'd be taking the car back from me without the cash, and I do mean CASH, in my hand first.I think you're being very lenient, I'd be after him for the cost of the tyres too, it's his fault you're losing out after all.
One point, there is no such thing as a "hobby with a business name", it's a business whether he does it for fun or money.

You could try Trading Standards too.
 
Looking at those pictures is horrifying. I'm contemplating sending mine to the 'scrapyard in the sky' and it is in perfect condition compared to that - only MOT comment was 'rust is beginning to show on the front inner wing'!! Sadly, the engine is on 252,000 miles :( so I have to be prepared for the worst.

I have been leinent as that the sort of person I am, I'd rather just get my money back no questions... but I've given him 30 days to collect and refund... if he doesn't I'll take him to court for everything, tyres, loss of earnings, interest for hanging on to my money, all the legal fees etc... then I'll name and shame. I think I've been more the hand reasonable but don't fu@k with me!

252K shouldn't be a problem for a well serviced diesel. My car has done 296K, and still sails through emissions, and runs well.

I don't think you could be blamed if you mistakenly swung your handbag in frustration as he was coincidentally walking by, while on your way to the DIY store to find some paint to match the house brick which was in the bag for that very purpose.

I do understand that but, as I live in the middle of nowhere and am totally reliant on it, I am very wary of keeping it 'just in case'. I am heartbroken about having to think this way but, realistically, it is best to replace it. My nearest shop is a 7 mile ride and the local hospital is 32 miles away. Add to this the nearest Tesco ( other supermarkets are available about the same distance away) is a 70 mile round trip. I know in my heart that it is the right time to think about a replacement. I like to travel over to France etc. but do not feel happy doing this for fear of a breakdown and having to deal with all the hassle in a foreign language.:(:(:(

Better the devil you know than the devil you don't. I drive to Cornwall, and anywhere else I fancy, in the car. It is well serviced, and always has been, and no more likely to break down than a car that has done 60K entirely on school runs and short trips.
My old car, a Saab 9000, had done 250K+. I used to drive that all the way to the far north of Scotland, from Cornwall, a trip of about 750 miles, very often.
Mileage isn't that important, condition is. As the OP has discovered, sadly.
 
Certainly not! Dont hand over a thing, at worst, it is your evidence of dodgy MOT and not up to standard. 30 days is too long. Cash in hand and i walk away, no cash i will take you to court. It is an open and shut case.
 
I think you will get your money back as he now has a headache which could potentially put him
in court, there's no way id let him take it without a refund plus I would remove the new tyres
you could sell them on here, as already said contact the garage which fitted them & get the
old ones re-fitted. If they haven't got them I am pretty sure the LZ mob could rustle up some
part worn's for you :)

You can find a set of D2 wheels and tyres on the bay or thru one of the many local breakers / specialists for around the £100 - £150 mark. May be worthwhile to swap them out and sell the new tyres on if you could put up with the hassle.
