Just trying to figure out how I'm gonna get the kids to school and myself to work in the morning
the disco should be driveable even if rotten, mot tester if its rotten are likely to be more vulnerable,it might not help you but will effect both of them ie dealer and mot garage

I don' have an issue with physically driving the car as school and work are only 3/4 miles away... but if I'm now not allowed to drive the vehicle as I have asked for a refund what do I do?
I've said the car isn' fit for purpose so driving it suggests that I'm ok with it being like that therefore have no case against asking for my money back.

fair enough ,i cant advise about that but i can on the trucks condition ie pics
 
Contact the garage that did your tyres as they will probably still have your old ones and explain what's going on, they may be able to put the old tyres back on....
 
UPDATE: Conversations with the dealer continued long into the small hours via text message, though I did refuse to answer his telephone call at 1.40am!!

I have thrown everything I have at him (in a very professional, polite manner). I have refused him any 'evidence' of all that he has requested so as he is on the back foot if this ends up going to court (which i have no issue with doing, simply out of principle. Call me stubborn if you will :))

Needless to say his emotions where a little erratic, Initially he spat his dummy out, saying "take me to court blah blah blah"... I continued with my 'professional' tone and forwarded him my consumer rights etc. Then he tried the softly softly approach making a deep emotional plea that "he works full time and doesn't need the money from selling cars' and that 'buying and selling cars is a hobby that has a business name' (boo hoo)

He wanted to offer me a suggestion 'informally' by phone call, I kindly declined and said I would be happy to consider his suggestion by text message so that we both have a record of it.

His suggestion was to either; collect the car, get the work done and flog it on my behalf... or... he has another couple of cars to sell next week and can refund me when they have sold.

So, I have agreed that he has 30 days from yesterday to collect the car from me and refund my money in full. (only realising last night it is the dealers responsibility to collect the car, bonus!)
Legally, I now know I am unable to use the car which has left me in a creek without a paddle but once again my stubbornness precedes me and i'm hoping I can call on some favours for getting around while i'm waiting for the refund.

I have parked the car up and taken photos of every inch I can including odometer reading. Ill see if i can attach some pics of the rusty bits (that actually look worse today than they did when I collected the car, think I may have 'lost' some more rusty metal driving it!

Very good, you'd have been more stuffed had you driven it somewhere for an inspection and they said it was unroad worthy. On a plus side at least you've learnt where the rust traps are :p

Yes that was my thinking, by driving it I am 'admitting' that I am okay with driving a car which I have been told is unroad worthy.
This motor has caused me a headache but I do still love it! I'm actually sad that it is as bad as it is. I will get another Landy in time, just because I think they are great motors, though as you pointed out, next time ill have a very good idea of what to look for!

good to hear ur sticking to ur guns and it all works out for the best , also as others have said drives me insane when a guy thinks he can downtalk to a lady

PS, what ever u do don’t ever repeat this, if u blackmail LZ members with tea cake and ask nicely they may offer to come and inspect ur next disco purchase, snigger ;):D

Thanks gstuart, I'll bear that in mind when I start looking for my next landy... I like to think of it as 'encouragement' rather than black mail. :D

u will find LZ a family community , where we help each other out and indeed be gents to ladies , as indeed that’s how it should be

even buying gloves so nails don’t get dirty when changing the engine oil, , see we all do care , lol
