It was advertised - thats why I have mentioned to him about the fact that he advertises that he has his cars inspected.

If it was inspected then the faults were known to him and he knowingly sold a duffer.

If the car was not ispected then it brings the Trades Misdescriptions act into play.

This is when he started to **** himself I think and is asking to get costs together to have it repaired if it makes financial sense to do so. I knwo that I do not want it repaired, and I now also know that its going to cost
him £2500+ to repair. So the refund is the only option.

As it stands, I am getting a repair quote, he stated that he wanted to collect it for him to get another quote done. After I have passed some of the info you guys have provided to me on to his solicitor he is now saying to see what my costs for repair are and he will then make a judgement to repair or refund.

We all know it will be a refund. Just a game at the moment.

I have also stated that if I do not get results within the week he will be recieving a court summonds.

As mentioned, whats £120 to get nearly 5k back.

Did you actually speak to the 'solicitor'? How did you pass the information on?

Is it the trader or the solicitor that has now asked you to see the repair costs?

If he had a solicitor involved I would expect the solicitor to be dealing with you direct.
 
Keith maybe a panard rod mount has come adrift and been put back in wrong place. Without the panard rods the axles can move side to side. That is the only thing i can come up with that would cause that sort of mismatch to the bump stops. But having said that if it misses the bump stops on one side it must surely miss the other side as well. Unless there has been a massive side impact that has bent the chassis a few inches. That would have caused serious structural damage long before anything touched the chassis. If it was the rear axle that did not meet the bump stop on one side for instance, the rear quarter would have been totalled along with the wheel axle etc. Hardly a economic repair on an almost new vehicle never mind an older one. Just as bad if it is the front that is out. Don't think we are getting a true picture here without seeing the vehicle everything has to be assumption. Ok, we can call the CV joint and brake pipes and the general underside condition, but anything more than that is not possible.

Also the statement "is missing bump stops on one side" might mean there are no bump stops there, has anybody thought of that.
 
Why does the trader think it's up to him whether to offer a repair or a refund? It's not.

He can decide whether to bodge/repair/scrap it when it's his again.

Grr.
 
Don't waste your time on repair quotes, there are good undamaged P38's out there for that sort of money. You should put everything in writing and send it recorded delivery, including your (contemporanious) notes of what the Trader has said to you.
contemporanious = legal term for notes taken at the time of conversation.
 
I have been speaking to the solicitor, and putting everything in writing.

The only reason I am getting a repair cost is so he knows how ****ed he is, the car wont be repaired.

He may choose to bodge it once its legally his again but the only option I am accepting is refund. As previously requested, as soon as the RR is on a low loader back to his I will post pictures of the car, the reg no, Vin no etc so no one on here gets stung with it.

FYI the Panrod has had a section welded into it.

I had the longest copyright case since Victorian times in the UK High Court, picked up a few useful words and phrases, another one is; " for the avoidance of doubt" it kinda makes people think that you know more than you do or there is a solicitor advising:D

Holy ****:eek: it's not even straight. A new panhard rod is £70 with the bushes pre-fitted.

It's obviously had a substantial side swipe which has bent the panhard rod amongst other things. A real bodger.:eek:

Wow. If they're willing to bodge that then it should really fill you with confidence over the quality of the rest of the repairs!

You just dont weld stuff like that. It may be ok for a mud plugger, or a desperate get you home bodge, but still I wouldnt do it (fact i cant weld, but still) That is seriously bad. Can end up with heat distortion, or depends how good welding is... You know what I'm thinking.
 
Wind up the heat, it is seriously a heap of **** and requires a full refund +expenses, who gives a **** what the trader wants-refund or see you in court.
No more waiting,stalling or bull****.(hope your getting advice from consumer direct) it needs to go
 
Take this conman to the Small Claims Court, check out their website, do it yourself online, cost something like £50 tops. He'll get served the papers in less than a week, and if between now and then you've sorted it out, simply withdraw the action. If not, it just reinforces the idea that you mean business.

The court will need to see that attempts have been made to resolve the situation, plainly they have, but not to your satisfaction, so keep all the correspondence. From this point on, put 'Without Prejudice' clearly in bold at the top of every letter or email between you, the stealer or his brief. This means that the contents of the communication cannot be used in court without your agreement.

letter should always be titled letter before action and sent recorded and signed for..

from the picture jay the rod looks like its been heated to straiten it as i cant see any weld marks or grinder marks to make the welds flush,the sooner you get rid of this pile of **** the better,dont forget to name and shame the dealer when you post details of the car so we all can avoid this tosser
