I think I can see wht's happened. Looks like the Audi pulled out from a parking space at the same time as the silver BMW estate was passing, which accounts for the damage down its right hand side. The BMW was tipped onto its side and scraped along the pavement:

Its windscreen and roof hit the telegraph pole - this matches the damage on the car very neatly:
View attachment 336617And that was probably enough to tip it back onto its wheels as it came to rest a little further up where that pile of debris is. That matches the sound we heard at the time, which was a scrapy, rumbly kind of noise which sounded like an avalanche, rather than a bang which is what you usually hear from accidents in our street. The length of the scrape marks suggest that the silver car was going considerably faster than the 30 mph speed limit, but then everybody does so on that road.

Well a lovely day here and we went to a "Toderovden"(Horse Easter) get together.
Its an excuse for a village party, not our village the nextdoor 1, we saw the horse racing bareback, but really they a cart horses so not used to the control needed. Some quite funny streeing and braking techniques on show:oops:. Had a chat with a few we knew, then decided that there was too much Raki & homemade wine being offered for the drive home:oops:, so made an exit.

Rained overnight but brightening now.
Bit of drama with herself's daughter's car. Received a minor rear ender (steady now Stan) , cosmetic damage only and the offender's insurance have written it off! They've offered her 4k to keep it, or 5k to take it away.
I suggested she look at getting it repaired and it would be profitable as the quote is less than 2k.
Any thoughts on cat. N write off issues anyone?
Is she going direct to the other persons insurance? If so dun't fergetted she dun't have a contract wiv them so can't enforce said contract in court. If they mess up a repair there's no come back. Same fer ripping oft. How much issit to buy a car of the same year and miles?

Sorry, but it is not as bad as that.
Maybe reduces the value by 20 to40 % which only matters if you want to sell it.
N is superficial so why would an engineer's report be necessary?

Now, a Cat S car is one that has sustained β€˜Structural Damage’ in an accident – whereas a Cat N vehicle has sustained β€˜Non-structural Damage’. Like before, a Cat N car will simply need to be repaired correctly to return it to the road – and Cat S cars no longer need to be re-registered as long as the appropriate work is carried out.

She wasn't the guilty party, if the worst comes to the worst she takes the other DRIVER to court for damages.
No need to talk about contracts.
Straightforward claim for damages. The judge will accept the garage's estimate of repairs, or she could get three different ones and use these. Or the highest.
Forget completely about "write off values" this is just a con insurance companies try on all the time and peeps fall for so frequently. The value of the car before the accident has no bearing on anything, it is totally down to the cost of repair as that is the "damages" she is seeking.

I have posted about this before with a link to an article from Land Rover Monthly about how to use the law to get any car rebuilt to how it was before, despite insurance companies trying to "insist" on write off value.

If you must talk about a contract then she'll have one with the garage that repairs it according to its estimate. If it doesn't estimate enough to cover the job that is their look out. Once they are told the situation they'll estimate way over.

We recently had a car repaired for Β£150 that the insurance company had estimated at just under "write off" value, by the local Frord garage at Β£1500. I actooly went and talked to the garage about how they could dare to estimate it at that much. (Her Pluriel was hit slightly in the side in a car park.) They basically were going to dismantle a heck of a lot of the car, do the repair and then put it back together again.
We got the guilty party to pay cash and told the insurance company to stuff it.

Fanks for all the replies peeps. AFAIK neither DVLA nor VOSA are advised about a Cat N. I'm cautious of getting too involved as I this would necessarily make me the owner of any solution. I've suggested she force the repair from the insurer but she, understandably perhaps, would prefer a fixed car and 2k in her bin. She's only had it a mumf and paid five three for it.
My last word was that she should look after it and basically run it into the ground so any losses would be negated.

The SRS light continues to stay off.
Replaced passenger side door mirror. I will need a flat one before departing but... MOT forthcoming...
Disconnected the fing in the roof wot works the alarm every time I lock it with the plip. Should have done this years ago!
Topped up coolant and windscreen wash. Rear screen wash is a bit hit and miss so might remove the spare wheel and have a butchers. (Don't think it is part of the MOT. )
I removed the big rear seat as I STILL haven't repaired it.
Tried to book a new test, the phone rang and was automatically answered but no one picked up. After 3 calls like this the secretary rang me back even though she wasn't in the garage. Apparently they close on Satdis but Russell the mechanic goes in and uses the facilities, he doesn't answer the phone! She thinks she may have a slot Weds p.m.
The plan is to now get hold of a local Indy I trust to discuss the gearbox issue while at the same time working on any MOT issues that may appear.

Son in law has offered to make us a plaque to commemorate all the dogs we have had that have died since going back and forth to France. So, 3 so far although he will leave room for other names to be added.
Thus W is a bit miz, and I had to help her to try and work out when they passed on. Passports and vet bills helped. :(

We are having "fun" trying to obtain documents from the hospicle under "Subject Access". :rolleyes:
