I have owned a 2007 Range Rover sport for 10 years in Spain LHD Spanish registered, last year it fail its ITV(MOT) for the first time because of side steps, it had previously sailed through at various ITV stations throughout Spain, how can I check if a) they were factory fitted b) if I can homologation them

I would say the best way would be to get a build sheet from a JLR dealer, if the steps are on it then it came from factory, I dont know if that was an option, but would think it was.
But as JLR market them I dont see why they wouldnt be accepted. But then I dont know the Spanish rules.
Or take them off for the ITV, Or go somewhere else.
