Would this fail its MOT for the hole?
Very solid around hole - no further rusting....

Yes.
It's bigger than a 5p and within 30cm of a suspension mounting.

Yep i would say they would fail you on that try filling it in with solid putty then keep painting over it with thick paint and it will cover it up but if its possible you should cut it out and weld a piece in

cheers guys - the chap I brought it off only put an mot on it in March for the sale and i poked this through with my finger last week....hmmmm, MOT stations - who'd trust em!

gonna weld a 3mm piece of flat bar over it on the weekend.
