Help needed

Hi guys need some help, i was on my way to look at a job a couple of days ago in the freebie, where i was on a 60mph road following x2 cars (focus 1st then a zafira in front of me) they were traveling close and doing 30mph max this is a good open road with no need to travel at such a low speed this continued for a couple of miles with some faster motors passing us all then for no apparent reason the both sped upto around 50-55mph, then without warning or indication the lead focus appeared to miss a turning 100-200 yards further on, and when almost passed the turning it took it off to the right casusing the zafira the brake irratically with clouds of smoke of course i reacted the same brakes locked and sliding i ended up in the back of the zafira, i was probably 2-3 car lengths behind there was nothing i could do i was also being pressured forward by a bmw behind riding my bumper, the focus floored it away at speed, the zafira didnt have its lights on (time was 19:55) and i dont recall seeing any brake lights either, the road was greasey as it was spitting

I beleive this is a scam due to the circumstances and the way everyting played out, NOT TO BE stereotypical or racist but there was 4 asains in the zafira that didnt speak awesome english, and the first thing they did was get out holding themselves ooing and arring, the only damage to the freebie is bust no. plate and spotlights, the zafira is prob a write off (un economical repair) tailgat bumper destroyed and prob bent chassiss..

wher do i stand and what can i do here i cannot afford my premiums to go up again, i use the van for work im self employed this could put me out of buisseness, and however the insurance companys cut it this was not my fault at the least it was the focus even if not a scam, there is a traffic cam further back on the road (the blue type you see on the country roads)...?

its a common scam to get into a crash and then claim for whiplash, ide inform the police of the goings on, chances that they have been involed in another acident recently. happend to a friend of myn.

Basically your screwed as you drove in back of them,that said insurance companies are aware of this fraud-tell them the truth and it may well be the driver is know for this and they will carefully check as the fraud is normally personal injury claims

i also tried to follow the focus after exchanging details and found that it was not present at any of the houses on the short road-which only rejoins the road it came from..

Sounds a bit fishy but you went into the back of them so it would be a heck of a result if you put any blame on them. If you could prove the brake lights had been disabled it would be a different case.

It happened to a mate of mine on a round about, just as he looked right to double check things, the car in front slammed on in the middle of the round about - quite a coincidence that there were 4 blokes in that car too...

just make sure you explain every lil detail to them and maybe a diagram

at least the mot hasnt run out like i 1st thought, thank god were in june not july.. i thought it had ran out the day before ... major panic...

I doubt the police would carry out an investigation as in depth as what I'm about to suggest due to there being no serious injuries or deaths, but here's one piece of evidence which could be looked into.

If, as you say, the brake lights were out, then the filament of their brake light bulbs will be cold when their bulbs were smashed on impact and will look very different to that of the filament of a brake light bulb which has been smashed whilst illuminated.

Bit of a long shot, I know, but if you could look into that option of preservation of evidence to aid your case then I would. Depends how far you're willing to go to protest your innocence.

question has to be WTF were you doing that close to another car at 60mph. And as for the BMW what if he was sitting on your bumper?? he obviously wasn't that close to you as he seems to have managed to have stopped??

end of the day you drive into the back of someone. it's your fault and you is stuffed..

I followed a car out of a junction turnig left as i looked right one last time the car in front had stopped in the middle of the road it had turned into for no reason and i hit it up the ars* occupants got out 'we seem ok but i think we might all have whiplash', that was 6 months ago, my insurance have tried 50/50 blame and i havent heard anything since 1st week in january.

very csi lol, but i dont think i actually smashed any lights in and if its a scam as i suspect then putting working bulbs in would be easy...,
1 saving grace could be the traffic camera a couple of miles back maybe it picked up the fact his lights wernt on? light ing uptime is 5/6 isnt it? not 7:55?..

SOmething silmilar happened to me, at short notice a car pulled in front of me and slammed his brake on, so basically reduced my braking distance. He too had been driving quite randomly, and I caught him doing somthing similar to a bmw the next day so tole dthe insurance company I thought it was a scam as he drove away with no damage then ckaimed a month later!

What I'm trying to say is Going in to the back of somone is not necesarily your fault. At the end of the day, the insurance company dont want to pay out either so if you tell them it wasnt your fault they should fight it for you, thats why you pay your premiums!!

your wrong it is absolute offense, only if proven that they are deliberately causing accidents can you stand a chance of claiming

insur think ist fishy enough to pass on to fraud team anyway and the fact the guy the have said was drivin simply wasnt they claim this fella is 40, he was at least 55, and oddly when i type his name into google (as you do) there is a badoo acc with same name and a pic of a chap who is 40 ish and 2 other pics of the guy who was driving prob his dad.. altho pics appear a few years old now and says hes a resident of portugal, investigator comin later to see damage to freebie..
