Can any body shed any light on my Defender 110, which I bought as a commercial from a dealer in Scotland, it has 9 sets, but has uprated suspension, alloys and general grabber tyres in accordance with Land Rover Bulletin, all done in factory, NOT modified after.

It is also a VAT qualifier, and I can claim ALL VAT on it.

Mrs Inland Revenue is hounding me for unpaid company car tax, not the tax I have paid which is Van tax.

Tax web site, hmrc.gov.uk states that HMRC are seperate from VAT dept, but due to different vehicles being on the market which are difficult to determine as a car or van such as crew cabs, they, HMRC, are to consider themselves as one with the VAT dept, and if a vehicle is considered as a van for VAT, then HMRC would too consider as VAN.

Also, HMRC state that certain manufacturers and dealers have been in talks with HMRC and you should approach them before buying to find out about a specific model, this has been done and I received a Bulletin from my dealer, published by Land Rover stating than my model the XS, and indeed my old model the CSW, as long as spec as above are to be commercial.

Unfortunately for me at present, Mrs HMRC has stated that these documents and proof are 'inconclusive'

Can anybody provide support to me please.
