what do i do when a defender i bought over 15months ago costing me £3k + £4k in mods and repair has been comfirmed as being a stolen vehicle and ceased by the police.
This is part of a huge stolen landrover ring originating in Birmingham.

would be great if anyone could help me.

i have receipts for absolutely everything ranging from the vehicle itself to plastic rivets, i have the log book, past m.o.t slips etc

-what do i do bout my insurance? can it be froze for the time being?
-just put road tax on it, can i claim that back?

just a few of many questions

Did you list the mods with the insurance company.

I just change insurance yesterday and they asked if any mods. If you list them no extra money for most.

So no listey no money, you get to list everytime . Insurance company's always win, they may let you think you win?
 
You get on the phone to your insurance company and ask all these questions. Depends on your policy, your liability, the police report, etc etc etc...good luck!!
 
You can claim the tax back. Get a form from the DVLA website, fill it in, send it off.
Almost like a standard claim, but you need a police ref number on it and some other stuff. Think it cost you extra (i.e. you don't get as much back) cos they have more work to do checking up.
 
I'm sure I have read a number of threads where people have managed to buy 'their' Landy back off the insurance company that own it.
Basically your landy was stolen over 15 months ago, the insurance company would have paid out the original owner for their loss. This means the land rover you bought actually belongs to that insurance company and they will want to sell it to get some money back. See if you can get details of the insurance company through the police.
As you have all the reciepts for parts/work etc you should be able to get that knocked off the price they want .... also bare in mind you are saving the hassle of selling at auction etc.

I think thats right, it certainly rings a bell anyways, definitely worth a try, let us know how you get on pal.;)
 
Firstly check with the Police - if your LandRover has been seized as evidence then it is likely to be required until the case comes to trial at least, and maybe beyond (in case of appeal).
Also check with your insurer, if you bought your policy through a broker ask them to help as well - does your policy protect you against having bought a car to which you cannot get good title?
If it doesn`t do you have a civil remedy against the person who sold it to you (because by definition he did not have good title to sell to you - think of it as a chain along which liability passes) - breach of contract , misprepresentation , Sale of Goods Act. He may well not have known , in which case he might pass liability up the line to whpoever sold it to him
Assuming the rightful owner was paid out by his insurance company then the car usually rightfully belongs to them, but at the end of a long court case they may prefer the easy option of disposing of it to the original owner or to you on a buyback. If you still want it - could be months, which is why you need to check the Police timescale and the purpose for which they seized it
If you are a member of a motoring organisation (AA, RAC etc), see if they can help. If you bought from a dealer try trading standards. You could also try Citizens Advice to see if they have any ideas.
Meanwhile you could reclaim the tax and cancel your insurance, and remember get proof of no claims for next time.
Its not that complicated if you think about it as various parallel strands of activity all heading in the same direction - but it will take time and patience
 
Also check your home insurance, you may have legal cover of some sort, this may help in the great paper chase to get the right to your vehicle back.

Don't think anyone has mentioned it but if you bought your LR on plastic, you have a claim against the credit card company also. Have a look at

Section 75 refunds: Free protection for ALL spending...

for the details of how to claim.

I've dealt with a few similar cases previously through work and basically, as has been said, the insurance company owns the car if they have paid the rightful owner out on their theft claim. They will not want to auction a LR of that value as they will lose money and it will be better sense for them to sell it to you. As you have plenty of paperwork for the extras then that will help in calculating a value for the vehicle. Don't forget also that you are negotiating to buy a stolen recovered vehicle which will show on HPI checks and therefore is worth less than a comparable 'unstolen' one. Don't let the insurance company try to sell it at the higher price!

hi tom sorry to here that mate . right iv been through this myself and im sorry to say mate but i theres not much you can do other then talk to the inshourance people who now own the car tell them wots wot and if you be nice they will sell it back to you for around £750 to a £1000 you make the offer they will take it the only down side other then the money is it might come back as a q.plate depending how much work was put in to changing numbers bla bla but you will not be able to do eneything intill the police are finished with it every ones case is diffrent but they had mine for 7months .as for the tax id give it a go but how will you get hold of the tax disc and phone your inshourance people say nothing about the matter tell them you no longer have the car and cancil you inshourance you wont get all your money back but you will get most of it
 
The police have siezed the vehicle from you, when they release it the insurance company of the person it was stolen from technically now own it, so you need to find out if the original owner wants it back (they may have moved on and got another) in which case you might be able to buy it from their ins company.
 
Cheers jamie, i sent all my invoices for all my additional purchases totalling 3060 pound, this is just what i could find, to the insurance firm who now have my landy. Its called QBE and they have taken my landy to a storage facility somewhere down south. I managed to get hold of my tax disc before it was seized and have since sent it back to the dvla. the police found the original plate that the car should be so shouldnt have to go onto a Qplate. should hopefully hear something back in the next week or two

Just out of curiosity, What made the police check your landy was knicked? Did they pull you over with it or did someone recognise it as theirs etc?
 
Sorry to hear of the OP predicament, i bought ma 110 off of same guy and wouldnt recommend him, i checked his feedback on ebay n it was 100% but then i phoned him n done a deal outwith ebay, wonder how many others have done the same and been unable to leave feedback
 
Its awful news Tom but what you have done is highlight another trader ' yan the landy man ' who has let the buyer down... the more you read these different posts on the different land rover forums the less amount of online reliable traders exist in my eyes....

I know its difficult but a permenant thread ought to exist naming and shaming these unscupulous traders... befor others jump in, and in the name of fairness... it maybe that ' yanthelandyman ' was unaware of the vehicles stolen status.

Either way I do believe some reference point online ought to be available.... atleast this post will hopefully flag up if a potential buyer in the future hits the search engine for yan the land rover man .

I hope you can negotiate something with the insurance. Good luck.
