He claims that he has bought some waxoyl and done the wheel arches. I told him not to do any work on it. I don't want him claiming that work was his and not mine.

I think I made that clear in the email to him. Let me check. Yes, I did. I made it clear. I don't think it will help his case if he refuses to let me inspect it. If he issues proceedings I'll make an application to the court to order him to let me inspect it.

Been better had you inspected it prior to it leaving your premises

@Richie24hr if that's correct you've just shot yourself in the foot. If he's offered to come and inspect at his cost but you've sprayed over any evidence you haven't got a leg to stand on no matter what photos you've taken
 

he doesn’t even take pictures before and after , asked him some pages back, lol

at least his reputation has taken a nose dive from many who have seen the poor workmanship and spread around the various forums

I am not sure you can tell him anything..... its coming winter and he needs to use it.....
He has pics and you don't... good luck with that..
 
there is no need for him to. He has already stated that it is too far and he doesnt want your firm of bodgers any where near it after the last fiasco. He only needs an independent expert witness to appraise the work and give a written statement, The court will, quite happily accept that.

No point in spouting your T's & C's - they wont mean **** in a court.
FOR THE RECORD
1. It is generally accepted that if there is a complaint about a firm's work the firm should have the opportunity to correct it. So even without my terms and conditions I think I am on firm ground legally in insisting that the car be returned for rectification.
2. My terms and conditions are very specific. If you are not prepared to return, do not proceed with your booking. By doing that I am prepared to lose customers. And I do lose some. They email me to tell me that they cannot accept this condition. (I can probably produce some of these emails). Fair enough. By putting myself in the position where I am prepared to lose business, I think that makes the clause pretty watertight.

Why are you only now mentioning this , when you have been posting since Tuesday, and on that day stated the T&C is to return the vehicle to you.

I would say most have been expecting that you have the vehicle returned to you, is this a sudden change in direction?

No, Not a change in direction. Mr. Smith refuses to travel to me on the grounds of time and expense. I need to assess the car myself. I believe that I did in fact do a very good job and photos of the whole underbody will show this. If there are a few misses they will fade into insignificance if I can show the whole picture. I believe that that is why Mr. Smith refuses to allow me access. I offered to find a garage myself and pay for it to be put on the lift for an hour.

Now he is refusing to let me inspect the car and he is saying he is going to treat the car himself. I've told him NOT to apply any coating to the car and that if he does and makes a claim I will make an application to strike out and show the judge my email.

I have done the bare arch next to the new filler cap only as the splash gaurd was taken off, I haven't done any more of it. Regardless of this ,all the work he has done is photographed. I have not sprayed over anything else nor will I , over 30 photos in my book is enough court evidence, it's not like I can take the hilux to court for an inspection.
After all this he wants to come and view it in my local garage to achieve what ? I would never return back to him now so regardless of his opinion what difference will it make other than taking up more time . His after service, emails, denial, workmanship are all way off the mark. Simply the photos do not lie . I'll have a think here, I find it all infuriating .

its got to be cheaper and better for your reputation to refund the guy

He wouldn't be allowed in the garage anyway from an H&S insurance perspective.... if it collapsed when was under it the garage wouldn't have a leg to stand on.

Fair comment and I would not like to inspect the car when on a two post lift. Those things are dangerous! But I'm sure someone in Durham must have a wash ramp outside somewhere.

The reason for the post initially was to basically let others realise just what service You get for £800 cash, I had tried emails for a week with Chris and got abusive messages back and realised I was getting nowhere whatsoever, this was then mirrored on this thread. We all know the situation, I had first seen the add some ten years ago in LRO magazine and thought this guy seems good, I personally chose to go ahead with this service. As it has clearly transpired along with other unusual scenarios the job fell substantially short of expectations, I have clearly shown the photos, there is nothing in the doors, tailgate , behind splash guards, lots of bits missed in key areas, shoddy , etc etc etc, it is not £800 worth of work by any stretch. I am not dishonest in any way, I am well known and respected where I live , have a family and have worked since I was 16, got a great set of mates and I'm an honest straight down the line type of man, this post was in no way an attempt to rubbish someone, I had originally asked for a small partial refund to rectify, since then the amounts missed just keep getting worse. I came on this forum as I believe this type of business targets this customer base, 4x4 owners, people should know truth, it is a case of right vs wrong, there are no grey areas in my book, it has cost me thus far over £1000. I have no intention of entertaining this anymore with an individual whom is clearly in denial and delusional, you can show him a picture of any rust, any section, you name it , it's a superb job ! It's clearly pointless and I feel embarrassed for Chris. I have no doubt that in the past he has done some good work but not on this occasion and his manner is the worst I have come across. Thanks all for the support however it's time to let it run its course in the small claims court. If I loose I loose it's simply principle.
