No, but under the Sale of Goods Act even private buyers are protected if the item was misrepresented or not as described.
I have the proof that rust was an issue in May when it failed its MOT, he somehow got an MOT elsewhere then sold the car saying that it was solid underneath. I have this in writing as it was on his advert. I also have the MOT failure information which lists other things too.
Problem is that with the transmission problem, he could probably have a counter claim against me, saying the item was not returned in as sold condition or something.
Lesson learned, do not be in a hurry to buy!
