No, but under the Sale of Goods Act even private buyers are protected if the item was misrepresented or not as described.
I have the proof that rust was an issue in May when it failed its MOT, he somehow got an MOT elsewhere then sold the car saying that it was solid underneath. I have this in writing as it was on his advert. I also have the MOT failure information which lists other things too.
Problem is that with the transmission problem, he could probably have a counter claim against me, saying the item was not returned in as sold condition or something.
Lesson learned, do not be in a hurry to buy!
 
i have spoken to trading standards and all this private sale sold as seen 'must be fit for purpose etc etc' is rubbish if they are a trader they are answerable but private sale we still havent got a leg to stand on :(
 
I am informed that if a private seller describes something as true that in fact is not true, then you are protected under The Act, however it means pursuing a claim through the small claims court. Unless you have evidence to back up your claim, this may not be the best idea. I feel that I have written evidence from him and from the MOT, so could pursue it. Trouble is, got to sort out the transmission first.
 
1)take it apart fit new parts or repair.Its logical nuts and bolts.

3)Enjoy learning from the experience and when ya rangie is good drive to his house and shoot him.
