What did you pick up from the site?

We used some of our son's DLA money ( and my carers allowance) for this disco, so was a hard spend anyway, makes it even worse now :(

Sadly mate anyone can pay a guy to give him a jazzy site and look the balls when all he is a ****.:mad:

One of the best 4x4 places I know has the most basic site going. the fact that he has taken the money in this way makes me even more mad.:mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad:

He has to relent.....or im sure a few members can pay a polite visit to advise him of his ways.

It was a hard decision to spend some of this money, but our two children, our son whom is autistic, with severe behaviour difficulties (whom we get the DLA for, and I get carers, as a constant carer for him) and our 7 yr old daughter love caravanning, it lights up our son's days, so we bought this disco, due to the Mondeo not reaching our caravan needs (in to twin axles, and towed a twin with a disco before, it never moved) we even went away and thought about the disco, and agreed if the dealer was happy to do everything for us, it would be right, obviously not :(

I just hope and pray it goes ok tomorrow, my hubby is a HGV instructor, so is able to get on the Direct.gov sites to check things, so glad he did, I just don't want it to go wrong tomorrow, I'm the weak one, lol.

Makes us wonder what he paid for the disco, it was up at £4995 (we paid it :() after doing the HPI check, and putting the Chassis n.o in, its worth £4050, us taken for ****s or what! We should have done the HPI before we bought it, but we've never experienced this before, first time for everything I guess.

Cat C is worth SFA in my eyes. unless you know 100% its history.

the main thing now is non-emotional speed of action to get your money back.

Lol, did have 1 thing to ask:

Of satisfactory quality. It must meet the standard a reasonable person would regard as satisfactory, bearing in mind the way it was described, how much it cost, the make, the age, the history, the mileage, the intended usage of the car and any other relevant circumstances. Amongst other things, this covers the fitness, appearance and finish of the car, its safety and its durability. The car must be free from defects, except when they were pointed out to you by the seller before you agreed to buy it or where you have inspected the car and that inspection ought to have uncovered the car defects. Even where a car appears to have a minor defect, it may still be of unsatisfactory quality if that defect could lead to extensive damage or render the car dangerous to drive.

Must be free from defects, do we have the dealer on this? The only defect I can say, the gearbox is really loose, and feels like the synchro mesh has gone between first and second gears (we never test drove it though, but started it up)

As described. This covers all statements made about the car, whether in writing, in a conversation over the phone or in the showroom, in a newspaper, website, email or text, or in documentation. If the advert states "air conditioning and CD player" then the car should come with these features and they should be working.

Said it had electric sunroofs on advert (though haven't printed this) it hasn't, told 5 owners, from what we can gather from the HPI report it has had 3 previous. Has electric heated seats, drivers doesn't work.

Do we also have something from these?
 
Yes you have him on both. Its not as described and is faulty(gearbox) unless you were made aware of this at point of sale then you have grounds for rejection.

Within 6 months - you are still covered by the Sale and Supply of Goods to Consumers Regulations 2002 - not fit for purpose or not of satisfactory quality - take it back and say it is unfit for purpose and you want it fixed FOC within *** days or your money back.

The obligations to provide goods of satisfactory quality are more or less the same as those stipulated under the Sale of Goods Act 1979 (see BIF 142 A Guide to the Sale of Goods Act 1979). The Regulations also require traders to provide remedies where goods are not of satisfactory quality.

The effect of the Regulations is to create an automatic presumption, in favour of the consumer, that any defect in a product manifesting itself within six months is 'inherent'. This means that the defect was present at the time of sale. The burden of proof is on the trader to prove otherwise. The Regulations also provide a time limit of six years (five years in Scotland), during which period any claims for compensation may be submitted to a court.

I think you will find that the peeps wot sold yu the car are legally obliged to supply you with a motor - unless yu bought it, knowing that it was defective.

As far as yo Mondeo is concerned. As peeps have said before, having the V5 log book is not proof of ownership. The car is still yours - I assume he hasn't given you a receipt for it stating that he has taken it in part exchange for a value of .....?
Although peeps keep mentioning "Cat C" - I notice that yu said "Cat D". Personally I wouldn't, necessarily, be worried about that. But, having said that, there are too many other things that ring alarm bells :(. Get the telephone number of Trading Standards, phone them on Monday first thing. tell them that yu are going to ask for your money back and the reasons why, so that they have all the info to hand. Then, when you go to the dealer, if he doesn't play ball, just call trading standards from his premises and tell them what is going on. If he has any sense he will capitulate immediately coz he won't want trading standards sniffing around.
 
What a sad tale :(. Take note of all the valuable information given by members, you'll need it. When you contact Trading Standards it's really important to get a name, and a direct phone number to that person. Could be a bit awkward if you couldn't get hold of the person at the sellers premises. You could also contact BBC's Watchdog, once they get hold of it they wont let go. Good luck.
 
when you go back to the dealer dont take the mondeo onto his premises ... park down the road.... then if he gets funny and tries to take posession or block it in just call the old bill

this wasn't a dealer in notts mate was it? he had two in at same time? specialist cars or something similar?
