Am I missing the point here?
As I read it, it's not Poppy's insurers that are the problem, it's the 3rd party's.
Poppy doesn't want to claim under her policy so as to keep her NCD, so is relying on the 3rd party's insurers to play fair.
Unless she paid for legal expenses insurance, then AF have no obligation to do anything to help her as I see it.
Or am I being thick?

No the point is claims handling is non existant, therefore flux selling the insurance product are responsible in respect of suitability.
Secondly as a forum sponsor you would expect some compassion, this isn't first or even second time we see flux inaction/apathy.

Some shoddy underwriters pray on claims as a way to maximise profit, they purposely make the process difficult and £70 on phone calls is ridiculous.

I'd also pen a short email missive to the local MP - they love stuff like this in the current climate... they also seem to have friends in high places.

Hunt out the MD of the insurance co's email address - both on your side and the other - fire off a missive to them, mentioning MP by name after you've had an acknowledgement from the MP's office, even if you just ring to check your email has arrived.
 
I started with Flux insurance and have now moved to NFU after being treated like crap when taking out my policy in the first place, I'd heard they were sh*t but thought it can't be that bad. NFU are more expensive but far better to deal with as my branch only has 6 people working there. So on first name terms already.

The moral of this story is "I paid peanuts and looks liked I'd of got monkeys"

An interesting question.
Firstly you would need to decide if the broker is merely acting as an agent for underwriter- in this case the underwriter bears full responsibility for agent if the agent acted with due diligence.

I would say that an insurance broker who selects from a panel of underwriters wouldn't be able to claim only acting as agent as they specifically offer insurance from competing underwriters.

Without posting reams of legislation, the customer should reasonably expect the broker acting on their behalf to act with professional experience and integrity to make sure the customer understands the insurance product and it is suitable for the customers needs.

Secondly a legal cover uninsured loss claim is amother way and does not count as motor vehicle claim from my personal experience and using ombudsmen.

While we are on it £25 amendments if they don't reflect true cost are likely a penalty and are illegal.

I hope all sorts itself out ok Poppy I have had problems with flux as well they are a bunch of useless ****s and have caused my motor to be lost in the system of 2 countries papers so most likely will never be road legal again, I hope it sorts itself out for you and you can enjoy driving your pride and joy again

Yes I have legal cover, but so far getting in contact with the solicitor is nigh on impossible, I've left countless messages and had no return of call as yet.
And have had no updates regards the claim today after being assured of an update frequently.
 
I think I will change this year Flux had been good but last years quote is a **** take for the ammount of non fault claims I have and milage I do. I think I will change!

Me too. I will avoid them. I was with Saga when my Focus estate was back-ended and they gave very good service, provided a Passat estate while my car was being repaired. Delivered the Passat and collected my Focus and did the exchange again when the Focus was fixed. I kept my no-claims bonus as well. Two years after that their insurance became too expensive, so I moved to Aviva. I now have the Focus and another car on one policy with Aviva for not much more than what Saga wanted for just the Focus.
 
Hers my experience.
About 2006 I was driving my Discovery 2 along a quiet lane near our house. There is a very bad 90 degree bend. As I was halfway the bend I saw a Peugeot 406 hurtling towards me on the wrong side of the road. I swung the wheel and managed to avoid a head on collision but the Disco took the side impact. The Peugeot was written off at the scene. I was convinced the young lad driving it had been texting and didn't see the corner.

The door on the Disco was twisted & I couldn't open it. I eventually got out and started remonstrating with the other driver calling all the names I could think of. I called my wife to bring a camera and the police. The lads mum arrived and after discussions with her son admitted in front of the police that he accepted all responsibility. Luckily I had the presence of mind to photograph the position of the two vehicles and the Peugeots skid marks.

The policeman wasn't interested as there was no injury and didn't want to get involved with my vehicle. By this time I'd realised I'd banged my head as there was blood all over me. He then had the temerity to ask me to drive the vehicle home which I refused to do as I didn't know the extent of the damage- this eventually amounted to new steering box, new front wheel, new front wing, new drivers door, new passenger door. The policeman did have the courtesy to admit if I'd been driving my daughters Corsa which I'd intended to take, I would have probably been dead.

Even though the other people had admitted liability it took me months to get my excess back and eventually I resorted to ringing the lads mum and threatening legal action and asking the police to review a copy of his phone records. It wasn't really her fault as she had told her insurance company they accepted responsibility - they just ignored her.

I also found out the police officer hadn't even given the accident an incident number and he refused to do it as no one was hurt. I made a formal complaint against him for and had a Chief Inspector visit me asking me to drop the claim as it would affect his unblemished record. He even said that in his opinion my car had been driven off the road away from the scene of the accident and not that I'd swerved up the bank to avoid a head on collision. He didn't even take a statement at the scene.

Eventually I got my no claims reinstated, a letter from my then insurer saying I was resolved of all responsibility and my excess repaid. I then dropped the case against the police officer.

All this took 6 months. The mortal of the story is don't give up and just keep chasing. I got the personal email address of the claims officer working on my behalf and I 've got to say she was brilliant. I was emailing her every 2-3 days to keep the pressure on.

I Insure 3cars, fiesta @ £13-50, Lexus @ £26-od and disco @ £26-od per month.

its about time I collated all 3 on one policy I think,
but the trouble is they all run out at much differing times, so I will be penalised If I end early any 2 of the 3`s Insurances - stuck!!

I Insure 3cars, fiesta @ £13-50, Lexus @ £26-od and disco @ £26-od per month.

its about time I collated all 3 on one policy I think,
but the trouble is they all run out at much differing times, so I will be penalised If I end early any 2 of the 3`s Insurances - stuck!!

If you go with Admiral on the multicar scheme they insure the cars for different times until they all line up on the same renewal date. Not that I am with them anymore, direct line was a lot cheaper.

Good luck with direct line, I had a non fault claim many years ago and direct line were total ****e, the insurance ombudsman intervention ment it got sorted,I had £600 compensation a year later.
