You're missing something.
When he says scrapped, he doesn't mean it was done properly at a scrap yard he just means it was destroyed.
Buy a knackered landy from ebay for £100 that doesn't have a hope in hells chance of getting an MOT then take the plates off it and destroy it. Steal a nice landy and put the plates on it and MOT it and hey presto, you got yourself a £5000 car for £100.

Before you buy the vehicle, you must make sure that all vehicle details provided by HPI match both the vehicle and its accompanying paperwork, and notify us of any discrepancies. As a minimum, you must obtain and check the V5 registration document with us, using our Document Check facility, prior to purchase.
You must check that all the VIN markings on the vehicle match each other and the corresponding V5 registration document.

I bought my defender about 6-8 weeks ago now off a genuine guy near where I live.

I had a visit from the police on Friday morning. Apparently my car is a clone. It was stolen around a year ago and transferred onto the plates of another older defender that I presume went to the scrap yard.

In theory I loose the car, it goes back to the insurance company and I loose the money I paid for it too. I did a HPI check based on the number plate and the VIN plate under the bonnet. Both of these were fake, so there is nothing the HPI people will do for me.

I have informed the insurance company that I would maybe be interested in buying the truck off them. Taking to account that it will be a newer reg, but also that it will be a Cat D, will have no history, no MOT. insurance will cost more etc. They said that an arrangement could be reached and if I submit receipts for anything I have done to it since I purchased it these would be subtracted from their valuation.

I really don’t know what to do though.

Any advice greatly received !! I am absolutely gutted ! Feel like crying.

Feel for you, had the same happen to me about three years ago, I was lucky the ****s actually stole it back off me, presumably to sell on again. As the vehicle was stolen from me my insurance paid out.

The vehicle that the identity would have been taken off would have been driven into the sea or something. That way it would never have been registered as scrapped. Besides I dont think the DVLA records are that accurate yet anyway ??

Because I used the old number plate and the VIN off a fake stamping plate under the bonet everthing tied up. I stupidly didnt check the VIN on the chassis, couldnt find it very easily where I thought it would be. (turns out thats because it had been ground off and repainted).

Will never not check that again ?
 
I think the HPI check I did was not as in depth as that. It was the kind that a garage would do when you bring you car in for a "trade in". You dont show them the V5, its just based on the VIN and the Reg Number.

Thanks for all the advice guys. Its a bloody nightmare situation. I think my only and best option is to
  • Get reciepts together for a bunch of work completed.
  • Document how much its going to cost to get back on the road. ie, MOT, Re register, re stamp chassis, new V5 etc.
  • Get them to take into account their costs to get the vehicle returned to them and delivered to auction, with action fees.
  • Charge them for storage on my drive.
  • Find out how much its worth as a Cat D.
  • Will my insurance go up ?
Then make them a silly offer of £1 and see where I get ?
 
What would anyone think an N reg Defender truck cab with 2" lift and a few other toys would be worth ? Obviously taking into account the Cat D.

I got £3400 when my 1997 110 was written off. The salvage value was summit like £900. I did have to fight for the money though. The assessor was trying to fob me off by telling me that if I left all the extra's on it (winch,winch bumper, snorkel, Mach 5 wheels, LED lightbar, Front and rear LED warning lights, urn, Siren/pa unit, etc) I'd only get £1100 for it. When I said that I'd take the £3k of extras off it he told me that I'd get less with them taken off. I told him to **** off and come back once I'd stripped it cos by his calculations I'd owe them £1900 if I stripped all the declared extras off it and by my calculations that aint right.

how long is a piece of string?

It's impossible to say without seeing it, it could be a complete dog for all i know, extras don't always add money, if it looks like you covered it in glue and ram raided Halfords then it will make it worth less rather than more.

that said, look on ebay, you can't get much of a 300TDi for less than £3K, in fact i'd say that there's not much you'd actually want to own under £4K. the Cat D status won't make a vast amount of difference to a vehicle of that age either IMO.

Ask the insurance what they want for it, if it's under ~£2k (and it should be) I'd snap their hand off.

Couple of questions. How much did you give for it in the first place? (that's probably as good an indicator of what it's worth than anything), and what age was it supposed to be? ie what age was the vehicle they took the ID from to clone it?
 
Aren't you guys forgetting the poor bastard that had this vehicle stolen off him in the first place? Surely he wants his pride and joy back too!

unless the original owner was unable to claim for some reason, say he left the keys in the ignition, then he or she will have been paid out by the insurance company, so the vehicle belongs to them now.

Given the length of time I would have thought he would have had the pay-out from the insurance company by now, they probably won't even tell him they have located it!

Ah.. I was beaten to it!
