going off track, but obviously it depends on a case bycase basis - I specifically stated abusive partner, where the action is spur of the moment rather than planned. My point being the differencve between being a "planned" death and one that happened on the spur of the moment. In this particular case, I assume it is argued that the perpitrators did not set out with the idea of killing the owner, but that it happened because of the circumstances at the time; hence manslaughter.

personally I reckon anyone convicted of causing a road death should be manslaughter, or , if they is convicted of drink or drug related offences, should be murder .

I'm sure they "accidently" drove at full speed towards another car where there was a person stood with a shot gun and smashed into the car and person

Poor bloke, trying to earn an honest living (we assume) and protecting his property and ends up dead

re the murder share, it's likely that the CPS went for manslaughter rather than murder as it's a much easier case to prove (murder being a mandatory life sentence and manslaughter carries an average 5 years).

Completely agree. I went along to the trial in Lewes earlier this week, and i felt that it was a bit risky that the defendants were allowed out and about during the length of the trial.

Four men who were part of a gang of burglars who crushed a businessman to death on his farm in Robertsbridge have been jailed for 36 years.
Brothers Terrence and Marcus Bristow, both from Great Chart, near Ashford were both jailed for 11 years for the manslaughter of Julian Gardner.
Accomplices Lee Delay, from Tunbridge Wells and Paul Dunn from Cranbrook were each jailed for seven years.
They were part of a seven-man gang who targeted the farm belonging to Julian Gardner in October 2010.
He was killed as he interrupted the gang as they ransacked his property.
The 52-year-old was found dead dead by his business partner less than 100 yards from his home at Bush Barn Farm off the A21 near Robertsbridge several hours after the burglary.
Today at Lewes Crown Court, Judge Anthony Scott-Gall told Marcus and Terrence Bristow that they had been prime movers in the burglary. They were convicted yesterday of manslaughter,
Lee Delay and Christopher Leek, from Cranbrook, were described as the foot soldiers in the gang. Delay was also convicted of manslaughter.
Leek was sentenced to four-and-a-half years imprisonment for conspiracy to commit burglary and conspiracy to pervert the course of justice.

"Those criminals now convicted appear to have shown no remorse for their actions. All those present that night bear responsibility and must live with Julian's death on their conscience forever.
"They know that they will eventually be released from their sentence. However, we as Julian's family will never be released from our sorrow."

Nope, they should be out on probation in 5 1/2 years.

and may get out even earlier if they behave and are deem suitable for electronic tagging. and as they will claim the death was accidental and not done thru Malice they probably will get out after 4years.
