A friend of mine (no, really) is starting up a sort of tour business (I can't give too much away about just what until he's up and running as he does have some competition).

A Landy is the perfect vehicle for what he is going to do, but he is getting conflicting advice from the local council who of course license Private Hire and Hackneys, and from VOSA when he enquires about if he needs to register or have a special license of any sort.

The local council confirm that he will fall outside their Private Hire licensing, but
Both VOSA and they have told him one time that he needs some sort of licensing, then another time that he does not. At one point they even told him he'd need a tachograph under EU legislation (otherwise known as the "lets make rules up that only the Brits will be daft enough to enforce domestically, giving mainland Europe a competitive edge" Directive 6/66). At the last update, they'd changed thier minds again about that....

Anyway, he plans to remove one set of side seats (for which read me doing it for him :rolleyes: ) and make the Landy ( Defender 110 5 door CSW 300 Tdi) an 8 seater.
His insurance company is perfectly happy about him using it for business and have given him cover to that effect, but he is concerned about how he keeps getting conflicting advice, as I both VOSA and our local council have contradicted themselves more than once, so he's kind of going in circles with it. At one point they suggested restricted PSV with safety checks every 10 weeks, proof a maintenance contract (all costly) and of course, hundreds in registration costs.

In effect, he will be transporting people from A to B. They will be paying for that service as part of the overall tour package.

The facts are:
1. He will be conveying as part of a business, in effect therefore this could possibly be said to be for hire or reward.
2. The conveying is not the purpose of the business, but is incidental to it.
3. It will be limited to 8 persons max.
4. He is already insured to do this.

Q. Does he or the vehicle need any other form of license other than normal?

Its going back a few years now but I ran a 110sw with 9 seats 2, 3 ,4 and the local council licenced that private hire.
If you go that route , its up to the council and vosa to argue it out if some conflict arose. as long as you have a form of licence , and its insured for that use. JMHO:)
 
Just licence it Private Hire and it doesn't have enough seats to be classed as a mini bus. PH will mean an mot every 6 mths. but it will also mean that if he ever has to visit london it will be exempt from the congestion charge.
