Its bloody noisy if you go straight through. I went that way originally and then put the small back box back on. Its moer comfortable now and still sounds good and improves the performance.

its also illegal under construction and use in the road traffic act.
all vehicles propelled by an internal combustion must be fitted with a silencer.

it might get through an MOT, as all it has to do to pass is not leak or be excessively noisy, but if you get stopped you will get knicked.

So, if I get stopped, what exactly do I get nicked for? As there is no decibel limit for road vehicles, and modifying an exhaust (certainly on any older vehicle) is legal, what would the ticket be for?

I'm not being gobby, or owt, just genuinely interested, as all my interweb searching has never given a precise answer to the "you'll get nicked" stance!

I was pulled over going through a local village where they had set up and inspection point, they were just randomly pulling vehicles over to do compliance checks. They went over mine saw I had a straight through pipe. Pointed out that I must have a silencer and nicked me. I pointed out that it was way quieter than the boom box Corsas and that it passed the MOT. I was told that does not make it legal....... I will dig the ticket out as it shows which part of the road traffic act I was nicked under.

Look forward to them stoppin me again then so I can ask them because they didn't say anything to me on Monday night when a got stopped

Smart......

I have just made mine straight through (300tdi) and its full S/S all the way to the rear and it's sounds nice.
But when I had it stop just behind pass door it was too loud.

I've done some more rooting about and found the following, which clarifies it all a bit:

Vehicles: Exhausts
Lord Teverson asked Her Majesty's Government:

Whether the modification or replacement of motor vehicle exhaust systems in order to produce a greater level of noise is in conformity with European Union type approval regulations; and what enforcement action they will take to discourage any contraventions of the regulations. [HL5603]

21 Oct 2008 : Column WA101

The Minister of State, Department for Transport (Lord Adonis): European-Union-type approval legislation in relation to vehicle noise is primarily concerned with ensuring that new vehicles meet specified noise limits and exhaust standards before they are permitted to enter into service. Mandatory EU-type approval requirements have been transposed into UK regulations.

Control of vehicle noise in service is governed by domestic legislation. Under regulation 54 of the Road Vehicles (Construction and Use) Regulations 1986, as amended, alteration of the exhaust system of a vehicle so as to increase the noise made by the escape of exhaust gases is an offence. The regulation forbids both the alteration of the silencer itself so as to make the vehicle noisier and the alteration of the exhaust system (by, for instance, replacing the silencer with one of a different pattern) so as to make the vehicle noisier.

At MoT, test vehicle testers are required to fail vehicles which are excessively noisy for their type. Enforcement on public roads is carried out by the police, who are able to take action if they suspect a vehicle contravenes construction and use noise, or other, requirements. They have further powers to address noise nuisance under the Police Reform Act 2002 and the Crime and Disorder Act 1998 under which anti-social behaviour orders can be served on the vehicle owner, imposing a ban from certain roads or even vehicle confiscation.

So, as I see it, modifying the exhaust to produce more noise contravenes the Construction & Use regs. Bugger. I'm currently running a de-cat downpipe and no centre box......and a Stage II tune, so it's good and "fruity" under power :)

I guess it comes down to Mr Plod and whether he's out to get you or not. Means roadside testing is of no consequence, as they'd have to ask you to take the vehicle to a test station, by which time the original system has miraculously appeared back on the vehicle..........

And it would also throw up problems of any vehicle with an engine transplant, as there would then never be a 'standard' system they could refer back to. Bring on the V8 Series II I've got planned :D

I'm going on a bit now, but here's Construction & Use (54) in all it's glory....

Silencers

54.—(1) Every vehicle propelled by an internal combustion engine shall be fitted with an exhaust system including a silencer and the exhaust gases from the engine shall not escape into the atmosphere without first passing through the silencer.

(2) Every exhaust system and silencer shall be maintained in good and efficient working order and shall not be altered so as to increase the noise made by the escape of exhaust gases.

(3) Instead of complying with paragraph (1) a vehicle may comply with Community Directive 77/212, 81/334, 84/372 or 84/424 or, in the case of a motor cycle other than a moped, 78/1015.

(4) In this regulation “moped” has the meaning given to it in paragraph (5) of Schedule 9.

So my system "does" compy, as it's got a silencer (just the one :D ) and I haven't modified it........not from what I fitted, anyway! And nothing in there about the system having to be as the manufacturer fitted, either.

If it isn't overly noisy and doesn't deafen people, I don't see what the problem is, tractor's make lots of noise, and their allowed to run on red diesel and have free tax??????

So? Tractors are agricultural vehicles whose primary use is off road. You don't find them outside the pub on a Friday night. New tractors have to be silenced as well.....

It's illegal regardless of how stoooopid we think it is. Therefore you are going to get nicked and fined and probably penalty points. The police are clamping down and doing spot checks. The motorists has always been a soft target. Landrovers are an even softer target because it's easy to check things like exhausts by the side of the road.

If you are in a Welsh place no one can pronounce then you are in the heart of intolerance from the police. The Nirth Wales police have a zero tolerance policy.

All very true, but I don't see what chavs are getting away with speeding around the place, I NEVER speed especially in 30's, so I haven't really given the police a reason to pull me, unless as you say its a random check, I've got a big silencer on mine as when I got it, and it's not really that noisy at all anyway

You are preaching to the choir here mate. I think it is as stupid as you do!!

However, we are where we are and currently a straight through exhaust is illegal. You run one at your own risk.
;)

Yeah true, having to put up with the rules it is then
