You can’t fit a chassis that is shorter either. As it is essentially the same end result as chopping one down.I thought that if the chassis hasn't been cut then it still was legal as a rebody.

A 90 has a 92.9” wheelbase vs 100” for a Disco?
Is it still 100”? If so. Then if cheap enough might be ok to look at.
As said. Depends what has been done. If it is just a body swap with a 100” wheelbase. Then it should be fine. Although not worth the same as a 90.How would i tell? how would anyone tell short of disassembling it?
the guy selling it had it done 14 years ago and says he was open and honest with DVLA who said to leave it as a discovery

Post some photos an we might be able to tell what it is (or isn't)there is a rebodied Disco I/II with an auto and 300tdi and a 90 van top on near me, I think it is correctly still registered as a disco.
