Sounds like it's in Sports mode where all up-changes are a bit later.
Is the selector sitting in the right place? i.e. clicked into D properly or just showing it is but is hovering between 3 and D.
Oil level?
When it does go into top at what speed does it drop back again?

It's not in sport mode, selector sitting on D, I can shift back to 3 and makes no difference. 38mph drops to 1500rpm anything below drops to 3rd and 2000rpm.
