OK, so how is a brand new TESTED battery fecked and how do I prove it?

Any info on that resistor info would be great as it's definately the EAS. I've conducted various test and everytime it is left at any other height than access, the battery goes flat.

What's the story behind the battery have you run it flat several times?

You can get your battery tested with a print out from Halfords explaining what's at fault ie dead cell ect ect my branch didn't do it but some do ring and find out . If not some garages will have one

Unless, as Wammers said, the timer relay needs a mod, the current draw from the EAS is very little when it self levels, which in any case should only happen every 6 hours, and if there are no leaks the suspension should not move.
