You are allowed to abate an obstruction on a Byway, but not clear it! Abate it simply means move it enough to allow free passage. You aren't allowed to widen the track.
You also aren't allowed to go out with the intention of abating a particular obstacle, in other words if you can't get through one day, you can't go back armed with a chansaw specifically to remove that obstruction. You're supposed to only move using tools and equipment normally found in your vehicle. How they can 'prove' sufficient for a prosecution I don't know ..
