For the road a Disco beats a Defender in every way possible, off road a Defender is only marginally better than the Disco (unless your doing extreme stuff), personally for 38K your going to get a very nice Disco2, I would possibly look into getting a bit more cash and going for a D3 as they are very very nice although you wont want to scratch it...
