If a catalytic converter was fitted as standard and is not present it is an MOT fail. Simple as that. Rule came in January 2012.

True but only in UK ... as the op hasn't stated his/her location which could be any where in the world :)

Most MOT testers these days wouldn't know if a P38 was modded from standard or not in any case!

Like some don't know the ABS light only goes out once it reaches above 4-6mph!

Was it a diesel?

On a petrol it helps if you have just two lambdas before the cats so if you remove the cats it won't affect running. I am not in the UK so no cats just more power.
When I removed the cats the exhaust noise was up so replaced the cats with small straight through cans, they look a bit like sports cats too!!

Does the Isle of Man have different MOT rules?

Belay that, just looked and they do. Far more sensible approach if you ask me. :);)

Seen this non cat exhaust system by RPi saying running LPG and don't need cats?? haven't looked into it too deeply though?? UK?

Range Rover P38 Stainless Steel front Exhaust System NON CAT Y Piece type V8 | eBay

Even on LPG they start on petrol and can be run on petrol therefore they MUST have cats. If the car qualifies for a full cat test and cats were fitted as standard, it MUST have cats no matter what fuel it is running on. You will note fail for no cats in the UK MOT is in the visual inspection section. Regs were tightened 1st Jan 2012.
