I've got a 3 door disco and the previous owner removed the rear seats can I fit some bench seats or do I have to refit the rear seats.

Anything is possible if you're prepared to make the relevant modifications.
Never seen that particular mod, mind.

How would that work for the MOT with seatbelts?

Not clear with where your going with this ? Rear seats ? If you have no rear seats i.e. the original rear bench seat, you can fit whatever you like, even a sofa from DFS, providing it is anchored to the correct MOT spec, and seatbelts / anchor points meet the required spec..Just look at what Clarkson and his guys make.
