Doesn't the fact that it was off ebay change it?


No where is the auction does it say 'head gasket failed or cracked cylinder head' , which is a fairly major thing not to mention .....!!!

If I do have a case, can anyone advise what I should do next? the guy basically didn't want to know when I rung him to tell the HG was bad, basically trying to sound surprised.
He has been at car sales 30 years he said, and I know his little crappy pitch as been there years, so I'm sure he is a right little wanna be arthur daley.

I did consider the threatening route, but instead told him if he got me the service history binder and paperwork that would do.
I don't mind so much if the head gasket cures it. But if I have to buy a new cylinder head, I will be seriously out of pocket. and any legal channels I have open would be good to know!!!

Print a copy of the ad off and pop in to see citizens advice.
It was not described as having major faults or sold as spares or repairs.
I think at the very least you should be able to get your money back under the sale of goods act as they are a dealer.
I don't think it was that cheap either.
 
It was cheap compared to a lot of dogs I've looked at... and it has been well looked after. Lots of new parts and invoices over the years.
unfortunately it's cleanliness was what led me to miss the Coolant issue.. I cant see citizens advice being any use to be honest..... but will give them a ring.

We have had many successes with getting people their statutory rights to a vehicle that is of satisfactory quality and fit for purpose for the consideration paid.

The Mad Hat Man and myself have helped people without charge to draft and contact dealers after being made aware of their rights.

the ad states it as being a 5 speed manual, looking at the pics id say its an auto. Falsely advertised, and doesnt a dealer have to mot a vehicle prior to sale unless it passed on through trade?

have I missed some sage advice somewhere? and I'm not being funny when I say that. I know I have to contact citizens advice, what else are you saying mate?

not that I'm aware of, it should be of satisfactory quality and fit for purpose.
The idea the chap is going to delve into major fault fixing before giving the dealer the chance to repair/ refund or replace in writing only weakens his position. IMHO

Very true!! It was incorrectly advertised looking at that.

Sold as seen from a dealer means nothing, six months warranty and can be upto six years under sales of goods act.

if he is a trader, then contact trading standards too. If he is s trader then I aint sure if Ebay would be very happy if he is trading privately??
 
Hi. Don't want this to sound like an 'I told you so' kind of message as I don't like the thought of people getting done over by dealers, and I've been stung before myself. It kind of shows the importance of being thorough when you're looking at a car or test driving it. I always try to give a car a good shake down when I test drive it - and a Merc I bought actually blew it's radiator on my test drive! The garage fixed it, threw in a few extras and I still bought it!

When I rang him to ask if he had the SH and leather binder for the discovery he had sold me his reply was 'what do you want'!!!

Hardly prime customer service material so I wouldn't be surprised if he says he wont do anything...

I was thinking this. It will be first thing on the list tomorrow I think before I strip the head off.
The cards are stacked against me though I think.
Paid cash. Off ebay. he seemingly doesn't have a proper ebay trader account.
Log book not in his name but the customers who PXd it.

I can imagine he will try and deny responsibility unless I record the call!

Your find we are tough love on here, but we don't like people being stitched up.

I'm sure your gutted/emotional etc- but you must set these aside and resist the temptation to delve into faults until you have followed the recognized procedure Citizens Advice will confirm and help you with templates.

You have scanned the Crock of **** thread and when you have done as the advice has suggested- I'll help via pm to construct a basic letter if you need help from someone who will help you avoid common pitfalls.
