Wasn't sure where to post this, so thought I'd have a go here.

I recently won a series III on ebay for a really good price.
I then contacted the seller in regards to pick up and how he would like paid.

He then replied that it had a reserve of triple what I won it at and therefore would not be selling the car. The auction did not have a reserve and my ebay page was telling me I'd won and to pay now.

Is it true that ebay is legally binding and he now has to sell me the car ?

Any help is appreciated.
 
contact ebay and explain it to them if there was no reserve on the auction then there was no reserve

I did, they just tried to move it on saying that they'd "take action" but didn't specify what it was. But they said they wouldn't be able to do anything else regarding me getting the landy
 
Take him to small claims court, its a legally binding contract he has to sell it to you

That's what I thought, but I've seen it posted that it's more hassle than it's worth etc.
Do you know of anyone who has done that and been successful ?
 
Dont waste your time. Not trying to be negative but you are wasting your time. There is nothing you can do. Court etc etc are just threats. If you were to go to court and he had to sell it to you he would prbably sabotage it and it would be worthless anyway. Move on and find another series 3.

Ebay are useless. I have had many dealings on Ebay and have learned to just move on if it doesnt go well. Sorry.

Yeh, this was what I though was the case, but I'm eager to see if anyone has had any experience in this with some success
 
maybe we should have this eBay name and all bid on it and not pay just for a bit of payback with a guy like that he don't deserve a Landy lmao
 
as has been said, forget about it and walk away.

It isnt going to happen.

If you like the motor and its a fair price then just pay the money anyway. ;)
 
I would walk away and forget about it.

It might have been an honest mistake forgetting to put a reserve on it, if you were the seller and did the same thing (i assume) you wouldn't sell it for the cheap price.

I suppose, but if it was vice versa and I accidentally put a much higher bid than I meant, he'd be wanting me to pay
 
Its yours mate.ebay always stick up for buyer.i sold some dr dre headphones with argos receipt showing they were genuine.seller said they were fake sent me some fake ones bk.then had cheek to contact ebay for a refund plus postage.ebay is a legally binding contract.the option is there for you to put a reserve or buy it now.so its his fault.ebay should go in your favor.good luck on it
 
i got stung on flea bay they did jack **** for me i sold a jap truck buyer viewed it and went on to bid on it long story short he came to pick it up and made the excuse that he was going to the cash machine after half and hour i rang him to see where he was and he said he was on his way home and didnt want it because it was not shiny enough reported to ebay and they did jack **** i said its supposed to be legally binding when you bid the woman said they could not enforce it so that was the end of it :mad:

The guy's a ####, ad him to your favourites so that when ever he lists an item you submit a stupidly high bid and never pay :)
