If the old owner of an ink black 1971 90/series/hybrid with series windows. whos V5 address was in Helsby/Frodsham, if you think you can help, please get in touch! I have just written to you to but matters have become crucial!

My heart goes out to everyone who has had their beloved landy knicked, I know serveral people who have had thiers pinich form the fron of their house.

Today though I was confronted by a truck driver who clamed that my rebuilt tax excempt hubrid mungral was stolen from his last November. I of course have to cooperate with the police who have now taken it away for further investigation. I got this form a reputable dealer who I still trust.
 
If it was bought from a reputable dealer - then the chances are you will get it back - its the guy who had it stolen that will loose out. You bought it in good faith.

that's wrong MHM, think you might have miss-read - whoever it was stolen from will get it back - anyone who has paid money for it since will be the ones to loose out
 
TA! yes, thats more or less what the law advisir said. The guy has already had the insurence pay out! Got s funny good feeling about this!

I'm off out for the night to kick some poker ass.

Its the "acting in good faith" bit. there was a prog on TV - watchdog or summat - it belongs to you, unless the police can prove yu knew it was stolen, in which case yu will get done for receiving. I think the just want to keep it, so they can verify VIN numbers n stuff without you getting rid quickly. As you said the original owner has now been paid - so doesnt have a claim. The insurance co would be the rightful owners anyway.
 
what will happen is:-if it was stolen and sold-the seller does not have good title to the goods.
This means that however many people it passes to-still title belongs to the original owner-unless they have had insurance pay out.

Then insurance company will have title to the vehicle-you may get offered to buy it back at an agreed price or they may dispose of it as they wish.

Take it up with the dealer you bought it from and speak to consumer direct

If the original owner was paid out by his insurance then as has been shown on several programs then the insurance company has legal ownership. You can sometimes negotiate with the insurance company to buy it at a discount but if you want to keep it you have to pay again.
If you know and can legally identify the person you purchased the vehicle from then you have a claim against him for redress, he should do the same but neither of you have a legal claim for the vehicle itself as he had no legal right to sell it.

I stand corrected - I have checked - and the above is true.
 
If you do buy it (again:rolleyes:) make sure it is fully recorded. One of the programs I refer to showed one poor sod who was pulled up at regular intervals by the plod cos it was still on record as nicked
 
I had a landy nicked 4 or so years ago. I know who did it and they got arrested after several months. He admitted doing it but the cps said there was insufficient evidence and dropped the case. The vehicle wasn't insured. DVLA still sent the new owner the new log book cos they don't care who it's registered to as long as they get the tax and any fines paid.

The long and the short of it all is that I never got it back. The only reason I got my money back on it was because I took matters into my own hands. The guy had a choice between arms and legs or giving me the money. Don't know why but he met up with me one day and gave me a big handfull of cash.:confused:

I broke even on the landy cost wise but it owed me 6 months labour. I've never put my full heart into any of my landys since.:eek:

Cos he sold it complte with keys, logbook, mot certificate etc to someone else over the other side of London. I located the car and got the police to put a 'care order' prohibiting the sale or modification of the vehicle until the matter was resolved. Due to the cps dropping the case the order was lifted. The police wouldn't give me the full name and address of the guy that had it or the guy that nicked it (as he'd since moved house) which meant I couldn't persue it though the courts.

As I'd found the location of the landy myself as the police hadn't even contacted me about my initial phonecall I was pretty ****ed about it.......






































So I set about finding the offender instead. :cool:

Have thumb through your household insurance and see if it covers civil disputes as from what you say this is not a criminal offence on your part. See if the dealer is covered by insurance for this sort of incident. Speak to CAB and see if you have a case against the dealer.
 
I thought that the title remained with the original owner. If the insurance has paid out then the title will belong to the insurance company.

If you bought it from a dealer then they are liable and legally obliged to return your money.

If it's a tax exempt hybrid thing, lets just hope it doesn't get inspected as it will no doubt lose it's tax exempt status and someone will be liable for a lot of back tax on it....

The duty of sales good act is ya only way but only from a dealer. As it is, i got it back and a didn't pay the compound holding fees which I was meant to. Happy days!!
 
NOPE. I didn't even pay the compound holding fees which I as meant to, amazing what happens when ya mention the press.
