I have just been turned down on over £3000 worth of repairs on front & rear diff plus centre diff lock by Land Rover Approved Warranty.

It's a 110 SW XS, 2005, 36,000 miles.

Land Rover Approved Warranty say I have invalidated the policy by fitting accesories without telling them: a snorkel and a roof rack.:mad:

Would I have a reasonable position in the small claims court, arguing the snorkel and roof rack could not possibly have had anything to do with the diffs and lock failing??

have you got the drive train warranty? or the full monty ?
 
i had a claim on my 56 plate 90 front diff fooked and i have a snorkel fitted never any quible on that, cant see that a roof rack is classed as a mod :mad:
 
tell them you remove em(ovbiously dont do it though).If they still refuse take em to the cleaners.



And burn it.
 
Been driving round the roads with the centre diff lock engaged have we? They do seem to be being awkward ****s though. It's well known that warranty insurance companies will do anything they can to avoid paying.

Land Rover Extended Warranty wants to invoke two clauses:

Clause 13
Modification to vehicle: If the vehicle has been modified in any way you must declare this prior to acceptance of the Warranty.

This warranty is designed to cover vehicles built to the manufacturer's original specification. If your vehicle has been modified with any non-manufacturer supplied parts that are associated to the items covered by the Warranty, we reserve the right to decline any claim (and any consequential damage) that may occur due to the failure of the modified part.
Cosmetic modifications are acceptable including wheels/tyres providing that they are the same size and specifications as the manufacturer's equivalent - you may need to advice your accident insurer of these changes.

and:

Clause 15
False claims If you make a false claim, this Warranty will be cancelled and you will forfeit all benefits. No refund wil be paid in such circumstances.

Land Rover Extended Warranty is not actually a Land Rover company. It is a third party that also provide second-hand warranties under other trading names I believe. They are based in Thornbury, West Yorks.

I would ask them to put in writing exactly how a roof rack and a snorkel could affect the drive train.

maybe have to go down the independent engineers route, or ask the LR dealer for their opinion. as it's a 3rd party warranty company, it's no skin off their nose.

as for putting in a fraudulent claim, that's just nonsense. how can it be fraudulent ? it's a genuine claim on an item that is covered by the warranty.

small claims court, or as the warranty is in effect an insurance policy, try Association of British Insurers. Name and shame the warranty company, perhaps they are members of a governing body.
 
I'd be tempted to firstly speak to Citizens advice Bureau, they usually have a good idea on where you stand legally. I would then advise LR that you intend to seek legal advice, the first statement you posted from the terms and conditions stated

A snorkel and roof rack cannot affect the problems you have. This is simply LR shirking responsibility, as its getting towards the end of financial year- they will have been told to cut back as many warranty claims as poss.

LR head office might be worth a call too - they may give the dealer a friendly word or two!

A friend of mine had similar issues with an audi A8 he had. Ended up getting all sorts of stuff sorted, like a £1300 set of tyres replaced. He paid £100 towards the cost, as a gesture of his goodwill.


Citzens advise is first port of call anyway

expect you'll find its the insurer that is to fault the stealers i dealt with on my front diff claims were definitely on my side (think about it they want the work and the good publicity not an irate customer ranting on the premises or to all thier friends (not to mention a certain public forum ;) :D ).
 
I forgot that most warranties are now actually administered by third party insurers. Used to have a BMW with extended warranty. Any probs at all were fixed, no excess, no hassle. Then the warranty went to a BMW Insured Warranty - effectively a totally different company. Every claim now had an excess to pay, the warranty went from £800 a year, to around £1200.
 
I think you need to go thro a main dealer to have any chance of success.
I had a claim at the end of my warranty period, dealt with it thro a main dealer and had no problems at all. They simply sent an engineer to assess and the claim was met in full, £4500 worth.:)

Imo your roof rack is irrelevent, just take it off.
Not too sure about the snorkel though, might cause a bit of difficulty even though its not connected to the problem.

a couple of points, Firstly the modified part hasnt failed(roof rack or snorkel) and int affecting anything related to wot has failed. Next are the parts ya fitted non manafacturer parts? There will be snorkels n racks in the landy catalogues without doubt-are yours the same as the spec sheets?
