I was out laning today in Essex. I've just purchased an up to date map. I know you cant rely on them totally, but here is my query.

I approach an entrance, which still has the moss covered stone sign, signifying the public byway.

I then come across a large painted white line with private painted in front of it. Beyond, is a wall creating a passage towards a large farm house. This is the only point of access for the lane.

Now I'm pretty sure this is the owner of the surrounding land trying to discourage use of the lane, not that I have an extensive knowledge of the laws, but I walked down to the house to query the situation, however no one was about.

Unsure, I turned around and carried on elsewhere. My query is this, where do I stand in a situation like this, and if there is anything that can be done or said if he is wrong? Or am I wrong?

Any thoughts, greatly appreciated, let me know what you think.

I think you did the right thing.

Don't drive it that day, but contact the Rights of Way Officer at the Local Authority & explain the issue. You can go into the Council offices to look at the definitive map & check it out once & for all. The ROW Officer will probably want to know as if a landowner is trying to block a right of way it could eventually become his by 'adverse possession'. ;)

I figured something was awry as I've noticed a few of the adjacent landowners to the byways try these tricks and being fairly new to it all, I don't have much ammo in the way of arguements/disagreements. Except the old "to pass and repass" quote.
