When i stopped testing for the minestry the back cross member of a landy wasnt part of the MOT. If it has big open holes with jagged holes then yes it might fail. BUT as its not part of the MOT and the holes are covered then it shouldnt fail.

That doesnt mean its a good idea or is safe. Its a crazy idea, get it replaced or weld her up.

I left my Iffor trailer in the middle of the road last year when the towbar and plate departed the old landy  The cross member was rotten and it passed an MOT just days before the incident.

The tow hitch mounting area is part of the MOT check, so if you have a dodgy x-member and towing kit attached it will not pass. It was 2 years ago I ran than the risk of failing next time if it wasn't fixed - I replaced the chassis!

If an MOTer lets a vehicle pass with a x-member so rotten it's going to leave a trailer in the middle of the road then I think that would be considered gross neglect of the tester and they would be considered in delicto if that vehicle was involved in an accident where the parts to blame could not possibly have deteriorated to an unsafe state within such a short time. Then they give you a hard time because something like the number plate light has blown!
